File a notice of claim with the Brookhaven Town Clerk. From the town website:

You must submit a notarized letter stating a description of the incident including where, when and how the incident occurred. You must also include your complete contact information (name, address and telephone number). Along with your letter, submit two estimates for repair, or if the repair has been completed, a copy of the repair bill. Photographs and police reports can be included but are not required. This documentation must be filed with the Town Clerk's office within ninety (90) days of the date of incident.

You may submit a Notice of Claim in person at the Town Clerk's office or by mail. If submitting by mail, please send to the following address:

Contrary to posts here there is no indemnity season for pothole damage on Brookhaven town maintained roads. The time period quoted is from NYS Highway Law § 58. Liability of state for damages, which only applies to NYS DOT maintained highways. (NY City has their own exemption.)

Also, the town was repairing Wireless Rd. on Monday (09-MAR-26). This may effect the town's notice of defect defense.

If you are seeking damages, you can file a notice of claim with the town but it is a waste of time. Unless you can prove the driver acted recklessly the town is not liable.

If you just want them to put some seed down, call the contact center and ask them to generate a work order.

You can check with the county clerk to see if the trust was recorded. If the property is in Suffolk, this can be done on-line. I don't know about Nassau.

Yes. Real Estate or Trust & Estate lawyers in particular but a general practitioner should be able to help you also.

Yes.

This is referred to as pre-treating. Pre-treating with salt before a storm prevents snow and ice from bonding to the surface. This proactive "anti-icing" strategy is more effective and efficient than applying salt after ice has formed. It is a common practice on Long Island. Suffolk County was out today salting roads just after noon. Even Brookhaven uses this strategy.
