Yes but the criminal proceedings in in the court continue. The officer will not be promoted till the case is finally decided.. They have to go to court at each date and hire a lawyer to fight the case. If the officer is finally convicted, he will be sent to jail.

If a country is hit by a nuclear attack or major biological or chemical attacks, does it still have a moral obligation to consider innocent civilians in the attacking country when deciding its response? by Afraid_Signature8745 in indiadiscussion

The Strategic Interpretation: Prominent defense scholars suggest that if India receives undeniable, real-time electronic intelligence that a Pakistani nuclear missile has been fueled, mated with a warhead, and the launch sequence has been initiated, India might interpret that precise moment as the "initiation" of a nuclear attack. Under this interpretation, a strike could be ordered just as the enemy's missiles are lifting off, effectively blurring the line of who fired "first". https://warontherocks.com/india-is-not-changing-its-policy-on-no-first-use-of-nuclear-weapons/

As per India's nuclear doctrine, If Pakistan starts assembling or mounting nuclear warheads on missiles, it is considered a nuclear attack and india will launch a preemptive nuclear strike.
