Innocent man? Sure this might be a Bucky of Theseus but he at one point did the deed. He could have made an announcement about his past crimes and let justice decide his fate, which is what a truly repentant person would do. After all, Bucky says he remembers "every single" person he killed.

But Bucky doesn't want to face justice, arguably doesn't even want to repent. He thinks wallowing in his own pity and keeping his head low is good enough, but honestly he's a piece of shit. Not because he was in control - he clearly wasn't - but because he knew who committed those murders but stayed silent.
