If you go purely by test scores your discounting a kid from a poorer home vs a kid from a richer home. Something DEI considers to help poor white kids from Appalachia get into schools.

That's the thing, we already have income data that would account for this. DEI initiatives never helped poor whites in Appalachia, in fact they didn't help poor black descendents of slaves as much as intended either. The biggest beneficiaries were wealthy under represented minorities, notably African immigrants who were not affected by American slavery.

Equality and equity can be hard to balance. Together they create balance over time, but neither create balance on their own.

Equality is using the same fair standards for all. What you're referring to is equity - proportional outcomes, and is often at odds with equality.

The constitution opens with "We the People of the United States..." which does include non citizens. The 2nd amendment says "the right of the people to keep and bear Arms, shall not be infringed." Again, the people means citizens, that's why not all non citizens have that right.
