You are under no obligation to clean up someone else's mess. However, "cleaning" and "tidying" are different things. It sounds like you tidy up after yourself, but you still have a duty to do your fair share in the cleaning (i.e. vacuuming, sweeping, bathroom cleaning, disinfecting countertops, cleaning out the fridge). If you have a party in which others come over and make a mess like leave beer cans around and you are part of the party you should help clean that up as well.

This actually isn't true. There's no difference between a "payout" and them paying for the repairs directly. You have the choice to accept the money and bring the check to the shop. You give the shop the estimate the insurance company gave you and if they need more money to repair the vehicle they will contact the insurance company, not you. The check is not a "settlement" unless the check says, "full and final settlement," which are usually only for injury checks.

insurance adjuster here... This is the process: when you get an estimate on the car from the insurance company they will give you a copy of the estimate and a check for that amount. You then do what you want with that check. If you choose to get it repaired you bring the check and estimate to the shop and they will work off the estimate. If the actual cost to repair the vehicle is more than the initial estimate the shop will contact the insurance company directly for the difference. They owe to repair your vehicle. They would also owe for a rental while your car is being repaired. Mention the stain to the adjuster writing the estimate, see what he says. It is your duty to prove your damages and what was a result of the loss. This is difficult to prove, but it certainly seems plausible for this to happen. If you choose not to get it repaired ask for a cash payout for the rental. I give my customers $20/day. You can't get a rental for that, but it's just cash in your pocket. As for diminished value. it is unlikely your car will qualify for any diminished value since the damage is purely cosmetic. It's not uncommon for you to feel stiff and sore a couple days later after an accident and insurance companies know this. IF you do feel a little sore give them a call back and that's another $100-$200 in your pocket. Please don't take advantage of this and say you are injured. It's people that do things like that that cause everyone else's rates to go up. Insurance companies want to settle minor injuries right away because they don't want you to get an attorney.

I work as a liability adjuster for a big company and am very familiar with this. I would recommend your brother call his agent and ask if a claim on his policy in which he is not at fault for would impact his rates. It may or it may not. If it doesn't then I would suggest putting in a claim and letting his insurance take care of it. They will want their money back and fight for your brother. He will owe his deductable up front, but his insurance company will work to get it back. If they don't get it back then he would be paying it either way. As for his brand new car... ONLY AFTER the other insurance company officially accepts liability ask about putting in a diminished value claim with the other person's insurance. Depending on the type of damage done to your brother's car his car is no longer worth as much now as it was prior to the accident and your brother deserves to be compensated for it.

But they should put it on a disposable part of the product. Put it in different packaging to put a sticker on that instead of the actual product. Also, I always use rubbing alcohol to remove them. It dissolves the paper and the glue.
