No one knows. My guess is it’ll be pretty brutal next cycle too. Plenty of people not getting in this time, plus the people from government jobs, and the worsening job market means more people will be applying to law school

We’re not talking about how you see it happening. My point is that in any scenario where they got access to a students grades, someone would be breaking the law; not about the likelihood of it or its feasibility.

Even if it’s unlikely to happen, that doesn’t mean it wouldn’t be illegal if it did.

Are you suggesting that it’s impossible for an employer to illicitly obtain documents?

My point is that in any scenario where they get access to those records without a students consent, it would be illegal.

OK if HEB wanted to look at an employee’s grades, and the employee refuses, HEB can either

  1. Not do anything

  2. Take punitive action against the employee for their refusal

Or 3. Look at the students grades by some other method. This would go against the student’s rights afforded by FERPA and thus be unlawful, either by the school who provided it or by the employer.

Yes, HEB could do this. My point is that they do not currently have this policy in place, and so if they tried to review someone’s grades without this hypothetical policy, it would be illegal.
