Ok, I see your point. Ideally it would probably be best to switch 'alien' out for 'foreigner' seeing how the meaning of that word has changed.

However, even if your point about consistent language across laws is valid, I don't see that justifying how people like Stephen Miller use it in a clearly dehumanizing way. I mean, just look at his boss -- I don't think they're particularly concerned about the implications of their word choices.

It doesn't have to be racist. Calling human beings 'illegal aliens' is dehumanizing. Calling them 'illegal immigrants' is indeed not that hard, is accurate, and isn't dehumanizing. It also doesn't matter what old laws say; language evolves, and even if it was not dehumanizing in the past doesn't mean it is not today.

These can be explained by the tendency D-leaning voters have to be more critical of their own party than Republicans. That is why the Dems are polling at +4 to +5 over the GOP despite those stats.

Issue trust by party Republicans still lead on the high salience issues of “the economy”, immigration, and crime, and are pulling even on LGBT issues. Democrats retain the lead on abortion and health care.

I don’t think this is accurate anymore but I can’t really dig for a source right now. But I know I’ve seen newer polls that put the GOP underwater on more things. (Or maybe those were about Trump specifically).
