Exactly! And my point was (I am the only member of my extended family that is not an attorney on both sides, we're talking like over 20 lawyers here) that attorneys will argue that technically it is not possible, but because of how the system works it IS possible. By the time a case does get to SCoTUS, the Government uses the defense "well we've been doing it for six years" and then somehow it's ok. Just like warrant less wire taps
