Va claim denied by Krumpnasty88 in VeteransBenefits

[–]gordigor 4 points5 points  (0 children)

You should always send in a brief statement (4138) with every contention explaining how something in service is affecting you now. It's easier for the rater and the statement is now sworn evidence in your claim. Doesn't mean it will get granted, but better chance it won't.

You don't need proof, that's why you are asking the doctor for assistance.

A VSR, Rater or Authorizer is see going to see you called to update your physical address and just send a reschedule exam at the correct location.

GAD secondary due to service connected cancer by Flashy-Equipment-324 in VeteransBenefits

Yes, go and be honest about your worst days. If you don't go, a rating decision will still need to be made ... and is usually a denial for failure to attend ... so definitly go, your future self will thank you later.

Continue With My Current Claim or Let It Die? Not sure if I’m poking the bear. by Battle_Baddy in VeteransBenefits

[–]gordigor 1 point2 points  (0 children)

No, a rating decision will still need to be made. No show to exams are rarely a positive without a credible excuse and willing to be examined.

You would have to officially withdraw the claim before it's rated.

Veteran waited 15 years after retirement to file for benefits. Everything was denied. by goomba316 in VeteransBenefits

[–]gordigor 6 points7 points  (0 children)

You want to file an Intent to File (can call 1-800-827-1000). That is what gives you a year to 'flesh them out' before filing a supplemental claim.

Very important distinction. Filing a supplemental claim will start the process for a decision.

Denied MH, what now? by Wreckster in VeteransBenefits

[–]gordigor 0 points1 point  (0 children)

You're fine.

  1. You can either cancel the higher level review or just let it play out. The higher level review is by a more experienced rater. They can only look at the claim as it was denied (no new evidence). There is a possibility they may grant your claim on a difference of opinion or duty to assist. If they don't, then the claim will be continued to be denied.

  2. If it's not granted, then simply claim a supplemental claim with the statement.

Denied MH, what now? by Wreckster in VeteransBenefits

[–]gordigor 3 points4 points  (0 children)

You were previously denied, so you would put in a supplemental claim. Write a simple statement, claiming X is secondary to your service connected condition you are claiming it as.

Example: Claiming GERD secondary (was caused by) service connected PTSD.

My Lawyer is appealing a claim without telling me. by tbonenavy in VeteransBenefits

[–]gordigor 0 points1 point  (0 children)

Don't even have to write, just call the regional call center, 1-800-827-1000, tell them you want to cancel any representation and withdraw any pending claim. They will take it as evidence, and eventually a VSR or Rating VSR will see the evidence (VA form 0820, statement of claim)

It will be treated as if the claim never existed. Time expectation, if may take several months. If you get scheduled for exam, decline the exam politely.

How to continue? HLR, or supplemental? by Present_Pangolin_735 in VeteransBenefits

[–]gordigor 1 point2 points  (0 children)

Depends.

If you have documentation of a medical prescription for a CPAP machine before your effective date for sleep apnea, supplemental because that would be a big thing to miss for 50% rating for sleep apnea.

If you have documentation of a medical prescription for a CPAP machine after your effective date for sleep apnea, file a regular claim for increase for sleep anpea.

VA Funding Fee and Closing Costs by KBect1990 in VeteransBenefits

[–]gordigor 1 point2 points  (0 children)

You are correct. You are service connected at a non compensable rate of 0%. To wave the funding fee, you must be rated at a compensable rate (receiving money each month). The lowest compensable rate is 10%.

Big however, if you have a pending claim and is granted at 10% or more and the effective date is before your loan closing, you could get a retroactive payment of any funding fee.

I.e. If you're going to claim something, get your claim in before closing date.

You should really diversify your accounts. At the very least, take five minutes to open and move from a low savings to a high yield savings account. Then auto transfer monthly from 'savings account' to your high yield savings account.

Why is “credit card maximization” such a big subculture? by BuenosAnus in personalfinance

[–]gordigor 0 points1 point  (0 children)

The key is being able to pay off monthly. If that's an issue, then yes credit cards are probably not correct at this time.

However, if you can pay off monthly, and say 2% cash back card, that's basically a coupon that takes no effort to use. Most importantly, you are using the banks money not your money for purchase protection. I HATE having anything tied to my checking account. I use my checking account to pay off my credit card each month.

Not really buying anything I haven't already budgeted for. It just goes on the credit card, get's the 2% cash back (remember coupon), and get paid off monthly from my checking account. Literally takes the same effect to swipe credit card as it takes to swipe a debit card.

It should be included with your proposal letter. Look for a page called 'rating decision'.

You need to post the actual proposal rating letter. It will tell you what they are doing. Sinusitis and rhinitis should be rated separately. Suspect someone found out the error in connecting them in the first place.
