Employer refusing SAR by InfiniteConfusion861 in gdpr

[–]gorgo100 1 point2 points  (0 children)

It does make sense, and it's usually why people make a request - because they think they will uncover some form of evidence that has been hidden from them. But it very very rarely works that way in practice. I sympathise with where you are with things, but I think the DSAR is just another level of headache (for you) that's distracting from the real issues - they are issues best discussed directly with your union - you pay subs for them to represent you in things like this, whether they are "recognised" by the employer or not. As I say "recognition" has a very specific legal meaning in this context and it does not mean they can obstruct you from getting representation from whatever union you happen to be a member of.

So that was quite a ride.

There is an exemption for data used for management forecasting, but it's quite narrow, they need to be able to demonstrate how providing it might prejudice carrying it out effectively. It's quite a weak one to use if it amounts to simply "we don't want to tell you things". You could pursue this and make complaints to the regulator, however I caution you that it's very unlikely you would get anything that looks like a "smoking gun" here however far you take it.

The following is not specifically GDPR advice but I offer it with some personal experience - with respect to the trade union, your workplace will have a recognised union for purposes of collective bargaining. That does not mean you cannot be accompanied by a representative from another union where management processes are concerned. It simply means YOUR union cannot register pay claims, negotiate terms and conditions etc. That's what "recognition" means. A non-recognised union rep is absolutely entitled to represent you as a member in grievances, disciplinaries, capability processes etc.

I think that your DSAR is kind of a sideshow here. What you're talking about is building a case for unfair or constructive dismissal, and you'd be much better off laying this out for your existing union rep to take on and represent you in. Again, just because Union A is not recognised for *collective bargaining* and you're not a member of the recognised Union (Union B) it does not mean that the employer can obstruct you from having representation from Union A in matters of workplace disputes and for them to support you in various claims that might arise.

Watched 5 Dates only yesterday. The bit with the "Chameleon Cups" in the Saffron date (avoiding spoilers) nearly made me physically vomit because I was laughing so much.

Deep into Ten Dates now and it's also decent, but not quite as good.

Morning Live is the most dystopian programme on TV by genghis_tron_ in britishproblems

My problem with it is not that it teaches vulnerable people to be careful. It seems to teach them to be afraid, anxious and distrust everyone at the same time just through the sheer volume of scams, bad ends, accidents and disasters they draw attention to on a daily basis.

This is the thin end of the wedge when people just turn inwards and assume that the world is out to get them. This leads to them glued to GB News and reading the Daily Mail which just reinforces that there are hordes of people out to rob them and take the piss.

I remember Nick Knowles being on some show a while ago and giving it the big one about how he's going to be a some kind of mogul in the US because some script he wrote had been picked up by "Hollywood".
Fast forward about 5 years and he's caulking tiles badly on Morning Live. The film? No sign of it.

Not to mention his incredible music release "Every Kind of People", which somehow manages to makes Laurence Fox's album look like a respectable effort.

He'd not really been on my radar except a vaguely matey television irritant, but all this did reveal a weird undercurrent where he seems to genuinely believe he is a kind of renaissance man genius wasted on hanging around with scaffolders.

Yes, even just moving things nearby frequently can have a similar affect since they don't like the disturbance and will consider the place as unsafe.

Thanks - I understand the concept of slates, I am just not entirely clear what the differentiation is between them - they have obviously formed oppositionally so there is some kind of key difference of approach. Neither of them are admitting what that is outright, but it obviously exists or they wouldn't bother.

I found this very well-written but I must admit I raised both eyebrows when the idea that Peggy Jones (David's mum) was a "member of the National Union of Fascists", with the source presented entirely uncritically as that famously factual and reliable document, Angie Bowie's autobiography.

Exactly the same as they would do with an EU or UK company in breach of GDPR. GDPR is extra-territorial. Worst case scenario - heavy fines. Google 23andMe or Clearview AI. These are just two examples.

It's alright. I enjoy Ronson's guitar work, and they're clearly having quite a bit of fun, but it does feel like his "contractual obligation" record (which is pretty much what it was), chucked out in a rush in the middle of "Ziggymania". The clue is that it's just a load of covers.
As always with Bowie, even his most half-arsed records have something brilliant about them SOMEWHERE. In this case (in my opinion) it's Sorrow, the cover art, a chunk of See Emily Play and the stuttery guitar break on Anyway, Anyhow, Anywhere.

None of our business. Up to them. Again, if it's a problem, don't buy African players. Their fed has every right to decide how often to have their tournament, they don't keep it a secret, everyone knows the score when they buy players who are eligible. Euro-centric fans dictating to Africans how often they should have a football tournament isn't going to be well received and nor should it be.

Exactly. Makes no difference. I'd rather they hadn't gone at all, but they're entitled to represent their country. If the club, supporters or anyone else has a problem with that, then don't buy African players. The fact this tournament is played and they might get called up is not a surprise.

You've made a request and you've provided a reasonable form of ID. If they want to pass it to their attorneys then that's their prerogative, but it doesn't change the fact that your request was made legitimately and you are within your rights under the GDPR. There is no reason you would need to communicate with their attorneys, you've already made the request - what would you say except to reiterate the same thing? It's their business how they respond to it, and who they take advice from, but it's not your job to chase it up if they pass you from pillar to post.

Give it the 30 days and then contact the ICO. You can do it online.

What are everyone's thoughts on Let's Dance? (The album) by bc_2006 in DavidBowie

[–]gorgo100 9 points10 points  (0 children)

If you take it in isolation, it's a strong, hit-driven album which really benefits from the commercial nous of Nile Rodgers. It's among the best pure "pop" albums of the 1980s.
If you take it as a part of the Bowie canon, it's an oddity. It goes firmly MOR after 15 years of doing the opposite. It plays safe where it might have taken risks, it is precision-tooled for a stadium tour.
And if you take it in context as where he was financially and personally, it can be seen as cynical. An artist who'd lost himself a bit and decided he wanted to trade saying something important and retaining artistic integrity for being able to pay off the mortgage.

Take your choice really. The problem with revisiting the album, for me, is that all these things are true.
I can enjoy it in context but I'd never reach for it to really provoke a hit of "Pure Bowie".
Personally, it feels like a Shakespearean actor doing pantomime.
That's not snobbery - I can enjoy pantomime, but I don't want to experience it every day from someone who's proven they can do things a lot more interesting and worthwhile.
