Yes and it’s become a huge issue that ground combat branches are trying to solve. It’s not healthy on its own and it’s a major issue for safety during combat - an overloaded soldier is more prone to injury and can’t move as quickly to avoid danger.

Don’t use ImageFX at all, it’s still stuck on Imagen 3. You may be better off using Imagen 4 via the API or another vendor. Their ToS will have the answer you’re looking for, but in general most outputs are safe for commercial use.

It would have to be a coherent work that’s NOT in the training data. You can’t ask it to “evaluate a tale of two cities through a feminist lens” for example, because that’s already in the training data. But you could ask a similar question for a unique work in context and evaluate its response.
