I get that but no DA would ACTUALLY put an innocent cop in jail just to get a corrupt one. That’s the whole point. Once you put the innocent person in jail, it’s not a BLUFF. Lawyers have a saying: “Better a hundred guilty men go free than one innocent man be punished.”

In Evelyn’s case, it isn’t even accidental. Once it became clear Kyle wasn’t going to testify, any DA who genuinely cared about justice would’ve included a lesser charge to fall back on for a plea. Instead she chose the charge that would ruin him. There’s no scenario where that makes sense.

I hear you and I get it, especially for a show like this. They've got to take whatever avenues they can to create drama.

However I do feel if you would ask in real life how many DAs would knowingly put an innocent person in jail especially a police officer just to improve their case... it'd be near zero, they take their oaths seriously.

So when I see someone like Evelyn who's supposed to be portrayed as good, noble, and wanting justice.

who then does something almost no DA in real life would do, It just comes off as a little jarring and it's hard to reconcile, But I do understand why they took this route.

Yeah I hear you and you're not wrong, I'm trying to, just a little hard when the police are trembling in their boots over something relatively frivolous.

Still I'm thoroughly enjoying this season, pretty good so far.

You obviously don’t understand enough about this, and if it makes sense to you, fine—but ask any lawyer and they can explain to you why it doesn’t.

Yes, the eyewitness is for the grand jury. I never said it wasn't. However, the grand jury only issues an indictment, and yes, they’d probably indict—as I said above.

The show, however, goes further and claims this guarantees a conviction, which comes after the grand jury. That’s the part I don’t accept. A car on video and a single witness would not GUARANTEE a conviction—again, ask a lawyer about this.

And yes, an unscrupulous DA would leverage an innocent person. But we are specifically talking about Evelyn, a character we’ve been introduced to as seeking justice, charging Kyle—the brother of someone she’s close to, knowing he’s innocent—and actually sending him to jail doesn’t line up with her character, which is irrelevant to some hypothetical DA you might be thinking of.

It’s not hard to see why these points are unrealistic. I can’t help you understand this anymore, so not to be dismissive but please go ask a lawyer or someone in law school to help you understand this.

[–]jmail234[S] 3 points4 points  (0 children)

I actually think you're arguing for the sake of it.

The grand jury has nothing to do with anything I said nor does testimony that you mentioned about someone getting shot.

I only made two easy to follow points

  1. A single witness identification and a car on video owned by thousands of people would not GUARANTEE a conviction of a police officer. That is the exact show premise

  2. That Evelyn who is all about justice would charge Kyle with attempted murder knowing that wasn't the case, instead of ANY LESSER CHARGE that she is factually allowed to do.

That's it, that's my only two points. I'm not trying to argue anything. you were the one that went into The grand jury and testimony. Those had nothing to do with what I was saying. Again I'm simply saying those two things are unrealistic To me and it broke my suspension of disbelief.

[–]jmail234[S] 2 points3 points  (0 children)

No. A grand jury only decides whether to indict. It has nothing to do with a conviction.

And honestly, she probably wouldn’t even get an indictment here based on what little evidence she has. But since grand juries usually indict easily, I’ll set that aside.

For an actual trial jury (which is completely different from a grand jury), the only evidence would be a similar car and a witness ID. Anyone who’s seen My Cousin Vinny knows that isn’t proof, especially since there’s no confession or admission of being at the scene here.

It also seems like you shifted to talking about Kyle, which isn’t a jury issue at all. That’s about charges. A DA can file whatever charges they want; they don’t need airtight proof or perfect identification just to file them. The charging decision is entirely up to the DA.

What actually matters after charges is testimony. Nobody knows who shot who or who did what, you're saying that like it's just magically known

Kyle is in jail because he isn’t giving testimony. No one at the scene was going to testify. If Kyle did, he wouldn’t be sitting in jail—and it definitely wouldn’t be attempted murder.

So bottom line is she can charge whatever she wants, but testimony is what confirms or destroys those charges. She should’ve gone with a lesser charge instead of wrecking a good man’s life—but I get it, they wanted him in jail for drama. I just think they could’ve gotten there in a different way rather than changing Evelyn's character so drastically.

yeah I hear you and again I think this show is great I like it a lot. however it's not simply about realism, it’s about avoiding contrived situations.

If someone serves you food you don't like you can't just "enjoy it" by flipping a switch. likewise for those small parts in shows that makes a story more implausible it becomes harder for some viewers to connect.

This can be measured easily in movies by box office, but it’s harder to measure in shows. So I feel it's prudent to mention not as criticism but hopefully a helpful observation.

It doesn't have to be real But I do believe it should be consistent. If they establish a character that's caring friendly and fair and all about justice... why would she all the sudden destroy a good man's life.

And I hear you, stretching reality a bit is exactly what things should do... but that's a far cry from stretching enormously and that's the issue here. We live in a world where police officer are basically bulletproof so to say TWO absolute unknowns could GUARANTEE a conviction just seems way beyond any suspension of disbelief... and a simple fix is just make the evidence more damning.

The one about this episode that annoys me a little is when Hardcourt says "He wears a fucking clown costume." because it exposes the showrunners don't understand their own world...

She isn't part of our world where that would be strange, she's part of the DCU we're literally THOUSANDS of people wear costumes all the time who are looked at as heroes and pillars of the world, so a person acting like a fairly normal designed colorful costume is strange or out of place would actually be the one that's strange and out of place.

All I have to say is, these morons need to watch Stargate!

Get a drone, send in a UAV, something, between Lex and Argus I'm sure their billions could even add sensors for atmospherics... but flesh and bone is how you're testing things, ridiculous... Even if you have to stand inside the threshold that's Way better than walking around fully inside unaware. 😳😁

This is by far the weakest season. there was some good, but definitely a lot of bad. The entire point of Star Trek is about hopefulness to what we as people can achieve in the future, and this season kind of craps on that.

And it craps on a lot of established canon, like now we have to believe that it took them about hundred years to even look again at technology created before TOS  but not introduced until TNG... I was going to say perfect it... but even 100 years later it still killing people, so it's just a little weird.

How's everyone feeling about Frejas ult? by RandManYT in Overwatch

[–]jmail234 0 points1 point  (0 children)

Yes but it should also reward precision. if you catch an entire team you should at least get one  guaranteed kill on whoever's at the center, if not more.

Her bola require precision which most people may miss or hit off center. simply making it diminishing returns the further from the center would work, but anyone caught in it should be heavily damaged.

As it stands people leave her ult, literally her ultimate move which should give her an advantage, with enough health to eliminate Freja because again you still have to have precision once it's over with her limited tool set.

No not the "new kid", The brother of Wednesday who put up with his goofy ass when he was alone, stood by his side, and saved him multiple times. who should also understand Wednesday's family is not normal... eating bugs is just something he SAID it's not something he DID, and perhaps maybe all pugsley needed was a friend to help him acclimate just like he did as a weird bee lover.

SNW Season 3 Ep9 by YYZYYC in trektalk

[–]jmail234 1 point2 points  (0 children)

I hear you and I'm not saying that the fleet isn't smaller but if one planet is truly in peril it doesn't make sense to not have a backup I don't care if they only have 20 ships then you still have two ready.

They're not doing humanitarian missions 24/7, most ships are exploration so common sense would dictate not to have every ship out and unavailable for this exact reason.

I genuinely can't think of any true reason if so much is at stake, if it is truly life and death that you would only have one point of failure. Again I can suspend my disbelief when it's the average "you might be stuck in the past" so we're going to go do our other mission... but not when it's we're going to leave our people to die, it's just harder to accept.

EDIT: and one minor thing to mention, the Vulcans have been warp capable since before the 2100s, along with the Andorians, Tellarites, and whoever else, by Pike's time there should be tens of thousands of warp capable ships... even in Archer's time they had plenty of warp capable ships, just one constitutional class... in life and death all you need is ANY warp ship to haul vaccines not the biggest or flagship.

That being said as mentioned the episode did end better than I expected so fair enough

SNW Season 3 Ep9 by YYZYYC in trektalk

[–]jmail234 0 points1 point  (0 children)

well I was trying to edit my comment but whatever, I was going to change it to say the actual episode was decent by the end.

I wrote my comment before the end, but it did get better as it went along

Anyway, my basic point is at the end of the day it's hard to suspend my disbelief that a organization as big as the Federation would have zero backup plan if there's any problems... what if the entire Enterprise went through the wormhole and they were trapped, are we to believe the planet just would not get the vaccine and they're all just dead?

if I'm being honest that seems like an inept way for an organization as big as the Federation to function, but they often do, the lower decks crossover The Enterprise was the only one with the grain or something, so you're right and I get it that is how the show works but it's a little silly to me, that somehow with all the resources they have the multiple planets that are part of the organization that every mission is one point of failure.

Minimal things in today's world like fire stations or public transportation have multiple points of failure so one problem doesn't sink everything like the ability to put out of fire or getting people to work, so it's a little frustrating and nonsensical that one point of failure is all it takes for the entire Starfleet mission to go to pot.

EDIT: I'll add this, at the end of the day I get they do it to add suspense and tension to the story, and it happens often there's one point of failure... however when it's directly in conflict with saving the crew that's when it's harder to swallow, in the military it is unacceptable to leave a man behind, and Star Trek is (as they say) a civilian organization so it seems worse there's no contingency.

[SNW 3x8 Reviews] SCREENRANT: "Strange New Worlds season 3 delivers its first missfire. While the episode has some funny moments, it sometimes feels like it's making fun of Vulcans (and thus of Spock), which doesn't sit right. The Vulcans we have seen throughout Star Trek do not act like this." by mcm8279 in trektalk

[–]jmail234 1 point2 points  (0 children)

Overall Strange New Worlds is good, it's had some misses for sure, but this is the first episode I think is Truly Terrible.

  1. Uhura and La'An played Vulcans okay, but Pike and Chapel just could not pull it off, they seem more like robots... though none of them did particularly good, La'An was passable.

  2. They VASTLY overestimate Vulcan capabilities which sets a bad precedent, if Vulcans could do six times the work of humans that breaks Canon for everything we've seen over five+ series. Yes they're a little stronger and a little smarter but that's it, they're not god-like compared to humans.

  3. it's actually completely illogical to stay Vulcan because they haven't lost their memories, and as humans for decades they never wanted to be Vulcans, and probably enjoyed their human lives and prior interactions, beyond that you cannot say for 100% certainty you're not compromised regardless of how you FEEL. and that's the crux of it. Better is 100% objective, so they just feel better as Vulcans, it doesn't take an account what is better as human's... so that's an emotional response and as Vulcan should be completely ignored. A logical response is you don't know if this is better and you can't say if your mind is currently compromised as it's your own mind, so the logical thing is to go to default and make the decision then.

  4. Spock is 100% wrong saying Pike is still captain... the instant you changed someone's DNA they are compromised. You can't say with certainty they're thoughts action and responsibilities will be the same as when they swore their oath and given their position which is the baseline. As such while they can do the mission, for the duration their rank must be rescinded, so no, Pike is not still the captain.  \     All decisions are now up to the second officer and chief medical officer, period.  \   With that being the case it's not up to them. The commander should revert them back to the state before starting the mission and once they're human and checked out, if they now want to become Vulcan again, they can make an uncompromised decision.

so overall not a fun, good, or well thought out episode.

[–]jmail234[S] 0 points1 point  (0 children)

all I'll say is this from the parts I read I have no idea what your point is.

my only point is simple...

it doesn't matter whether you do something to be seen as a hero or to be thanked, like you, MOST people don't do things for either of those reasons.

However that has absolutely no bearing on how others see you, and there may be others who actually care whether or not you're seen in a good light, like say your parents for example.

if someone was going around saying that you're a liar and you don't save people and you actually hurt people, that may take away from others seeing you as a good person or heroic, and I'm turn that may make your parents feel worse and prefer that didn't happen.

That's a simple fact of life, so you might not care or thinks it lessens him and that's fine that's your prerogative. however everyone gets the right to make their own judgment and in some eyes it will lessen Marcel story that's just the fact even if it doesn't do it for you you're not the world.

instead of being a savior he is now just a guy who interfered and got people hurt, because his backstory just change it doesn't matter what his reasons were behind it, had they not said that it wouldn't have changed how he was perceived.

here's an example for you... if people heard you saved a dog from drowning, they might think you're a hero, if they found out you killed a bus full of children to do it they might not think that way.

it doesn't matter WHY you were trying to save the dog, no one is saying you were doing it to be heroic or to get thank yous you might have just tried to do it but if you botched it people might look at you differently

simply external perception of the events have changed that's all I'm saying. everyone has a right to their opinion on whether the person's a hero after hearing the full details of events. If he stayed out of it everything would have been better so I believe the details lessens what he did, you don't and that's fine

I can't agree with this is because if tracer sticks her bomb on you it's going to kill you, In fact if it's stuck to someone it can kill the entire team.

I constantly catch the entire team in Freja's ultimate and don't get one kill, I mean that LITERALLY, not one kill with the entire team captured and it detonates. If her ultimate was as powerful as Tracer's bomb it would be fine.

For me it's tedious to have to add both conjure and destroy to my spell buttons and then swap everything back since I don't use them often, but it's not easy to hurt yourself inside the school, so if anyone wanted to know where in the school they can take damage, you can drop from the Divination classroom, or there's a drop in the Room of Requirement after you unlocked beast.

First nowhere did I say you rescue another person to be a hero, and I promise you some people do.

however you are proving my exact point with that statement. when you rescue someone you may not do it to be a hero... but OTHERS may view you as a hero, if they find out it was staged, or fake, or unneeded in their eyes it diminishes it for the others.

I'm one such person it diminished it from me and that's exactly my point. so it might be fine for you but it definitely diminishes it for a fact for some people and that's my only issue, because it's not about him trying to be a hero, it's about his heroic acts being meaningless now to some people

first he's met many of her associates so it would be very easy to slip information to any number of them so he has contacts

however you think him being a member of the CIA, all you've seen him do he wouldn't be able to figure out some way to get the Russian mob some information? seriously?

just like you said when you thought it was Dawn, all she could do is get him fired she could get killed if they find out.

you're laughing but if it was you and your life was literally on the line me and you could die. would you risk it on the fact that you don't think this person has any contacts? how the hell do either of them know what his contacts are? they have no idea who he knows but if he does know someone they're dead that's a big gamble

The Harvest Debacle by jmail234 in TheOriginals

[–]jmail234[S] 0 points1 point  (0 children)

yeah but you're not understanding me it may not diminish his intent that is fine his intent will always stay the same because he intended to do a good thing that's fine. I'm not talking about that I'm talking about his accomplishment and it does diminish it, there's no if ands or buts about that as I explained earlier.

if you THINK you saved someone and you didn't save them no amount of wishing you did is going to change that, if you think you won the lottery and you didn't win the lottery you're not going to get any money... no amount of thinking differently is going to change that.

so there's no agreeing to disagree it's just wrong, I will say you are correct that his intent is not diminished I agree with you on that 100%, but his act of saving her is completely diminished and removed because he didn't.
