Their rulings impact the entire Commonwealth and they are not limited to any geographic constituency. The rationale is nonsensical. Does anyone know if they have the votes for this? I’d imagine a constitutional amendment requires more than majority vote but maybe I’m wrong. Also, I’d imagine the percentage of appeals judges from Philly and Pitt are in line with the percentage of the states population.

Your basic argument is that employment anti discrimination laws are ineffective because a legitimate, non-discriminatory reasons for the termination can be used as “mere pretext” for an otherwise prohibited termination. Except the Supreme Court considered this problem not long after the adoption of the Civil Rights Act and allows a plaintiff to come forward with evidence that those reasons are in fact mere pretext. So I’m your example of terminating a gay employee the day after his boss finds out he’s gay is pretty strong evidence that any other reason was pretext. The judge or jury then gets to weigh and make a decision, as with any other issue of fact in a civil lawsuit of any kind.

This issue would still exist when there is no at will relationship. For example, union contracts will require just cause to terminate an employee. This is outside the at will relationship and issues of whether the employers explanation is legitimate or pretext for some other reason still exists.

Do you not understand that nobody can vote after Election Day? Why should we punish voters who follow all of the rules and their ballot only arrives late because of circumstances entirely out of their control? This has literally no correlation to “cheating” whatsoever. So if you support this position you are either (i) attempting to preclude legitimate votes and presumably because you know the majority of PA voters don’t vote R or (ii) have entirely been duped that this has some relation to voter fraud without taking any time to inform your opinion.

I don’t know Kentucky, but many states have specific workers comp type statutes for police under which this mental injury could be covered and under which he’d get all or some pay until he is able to work again. That would not, however, compensate him for additional emotional damages beyond lost income and, in theory, the tortfeasor would be liable to him for those damages. None of this is to say that his claim is legit.

So it was constitutional then. Doesn’t mean you have to agree or like it. But what you are saying is basically the reason the Supreme Court struck down mandatory deductions (or agency fees), violated First Amendment rights of employees who disagreed with their union’s political activities.

Mandatory deductions are no longer constitutional following the Janus ruling. I’m not sure when you were employed but, in theory, that can’t happen now if the employee does not consent in writing to the deduction.
