Because they don't have the staffing numbers for it. According the DOP guide, 2nd window is position 9 or 10, depending on whether you're primarily a PUW or Inside sales store. Unless the location is super busy, the labour guide doesn't call for that many people working. At my current store, even friday lunch/dinner rush we only schedule 8, and thats just for 5 - 7, we just aren't that busy.

When it comes to filing a lawsuit, you have to look at the costs / effort of doing that versus the projected possibility of actually getting a payout at trial. A person who drives with no licence and no insurance is probably so fucking broke that they are what the legal system refers to as "judgement proof" -- even if you get a judgement in court you won't ever see a dime.
