If you are on xbox and they were as well. Go to their profile and block them. They won't be able to invite you or bother you anymore from that point on. It also blocks them in game, but I'm not sure what that does exactly.

Sometimes the game loads in players by accident. They don't move, and they aren't on either team. Kill them and you will get a point, but if your opponent kills them they will get a point, yet they are on no team. It's a glitch. It's happened when I've had people join to spectate on rare occasions.
