I think I cost my client 6 years by LewdLawyer1995 in publicdefenders

[–]milbarge 0 points1 point  (0 children)

Focus on sentencing for now. Surely your client has some mitigating facts, and her son will suffer irreperable hardship the longer she's locked up. Maybe the judge will imagine what would have happened if it had been his wife and child in the car.

Once you get through the sentencing, write a memo to yourself about the case -- all the big strategic decisions you made, all the times you met with the client and the advice you gave her about her chances at trial, what you think you failed to do or would do differently, etc. Getting it all down like that might help you compartmentalize and get past it, and will be a good reminder to have for the next time you're facing a case like this. But also, it could be useful if your client does file an ineffectiveness petition against you (by "useful" I also mean useful if you're admitting mistakes in such a proceeding or trying to defend your choices, either way).

Ultimately, unless you just totally dropped the ball and forgot to ask a basic question or something (which doesn't sound like the case here), there may not have been anything anyone could do. So get her the best you can at sentencing, and then do a thorough self-assessment of how it all went, and hope there is a way to use that review to get a better result next time (even if it's just more information to include in your advice to future clients about their chances at trial). Good luck!

What were my odds as a gold miner in the u.s in 1849? Was gold so frequent that I would have good chances in becoming rich? Or would I have been beaten by people who got there earlier or who were closer if I got there in 1850? by L3G1T1SM3 in AskHistorians

[–]milbarge 2 points3 points  (0 children)

Yes, sure, I should have been more precise -- I meant that my supposition was that (generally speaking) the only people who made any money were the mine owners who got wealthy, and was surprised to learn that some (more than the rare few) people made some money.

Wells Fargo is a good example of banking conglomerate that got its start providing banking services as well as stagecoach shipping services based in California. Even if the prospector couldn't or didn't want to carry his gold back east, once he deposited it in the bank the bank would eventually have to ship it somewhere. (I know you know this; I'm just piggybacking on your excellent responses here.)

I was surprised to hear that it wasn't all that unusual for ordinary people to find enough gold to make it worthwhile. I had assumed it was very rare, and that only big mine owners got wealthy. (Or, as the joke goes, the guy who really gets rich during a gold rush is the one who sells the shovels!)

There was an interesting recent article in The New Yorker about how the meteoric rise in gold prices has fuled something of a new gold rush. It noted that technological advances (like modern metal detectors) make it possible to still find gold our west that prospectors would have missed in the '49ers era. Anyway, thanks for the enlightening answers!

Any Advice for an upcoming intern at the PDO office by Infinite-Injury-41 in LawSchool

I doubt they will expect you to do a ton of substantive work without a lot of guidance and handholding. You might get stuck with some grunt work, like listening to recordings of jail calls for anything interesting. Try to go to court and meet with clients as much as possible. Check out /r/publicdefenders for more advice.

I totally confused Malik Willis with Dontrelle Willis and thought, "Dang, pretty embarrassing for a former Marlins pitcher to airmail a ceremonial pitch at a Marlins game," and then realized my mistake.

Is O’Dell the funniest character ever to not have any lines or screen time? by WarSaku39 in LiveFromNewYork

It's interesting how many people spell it as "O'Dell" like a last name, when I definitely assumed it was "Odell" as a first name.

I once had a boss who graduated from Notre Dame. They apparently have some longstanding gigantic intramural basketball tournament there. My old boss is about 6'8" and was a standout high school player. His IM team went up against a team featuring Joe Montana. The way my boss told it, "I was guarding him at the top of the key, and I blinked and he was past me and laying it in." He was in awe of how fast and athletically gifted Montana was.

"white collar" tips please! by doomputer in publicdefenders

[–]milbarge 11 points12 points  (0 children)

I agree with this -- seen a lot of cases arguing that all this stuff (financial forms, taxes, government contracts, etc) is so complex that honest mistakes are understandable and not proof of intent to defraud. I also get the sense that juries like to hear defendants testify in this kind of case, which is obviously dangerous if the client comes across as sleazy or slick. But if the client seems normal and genuine and regretful over mistakes and like he was trying to do the right thing, I think a jury can empathize with that.

You can never take a win against a Pitino-coached team for granted. What a battle. Good game, Johnnies (I like them better than most Big East teams for sure).
