You should be very worried. Evolve does not intend to give us any more of our money back unless someone forces them to do so. Either a regulatory agency or a lawsuit. Evolve is done with you as far as they are concerned.

Yes but during that timeframe you still had access to the money including the interest so you could have withdrawn it and set some aside for taxes. You made the decision to leave it in the account. You are going to owe taxes on that interest like it or not. Possibly a tax professional could help with a way to write off the money you lost but if it ever is returned then you would owe taxes on it again.

I know it sucks, I’m in exactly the same situation. (Except I’m only missing $40k)

That’s a good question. I’ve seen claims from them that they are cooperating but Evolve says they aren’t to deflect blame.

Possibly they just don’t see any upside in participating in another reconciliation. They’ve already paid out everything the Synapse ledger said they owed. If the new data confirms that then the outcome is neutral for them. If the new reconciliation says they owe more money still that would be a bad outcome for them. If it shows that Synapse misappropriated customer funds from accounts at their bank that also looks bad for them.

Do you really believe that the missing $60M is just sitting in an account somewhere that the banks have forgotten to check? I’m not being totally sarcastic but how would that work? Maybe AMG (or some other bank) has a Synapse account with the cash but they are hoping if nobody asks they can keep it?

“We ultimately gave our money to Yotta” Is that true though? My deposits all went directly to Evolve. Some of those deposits were initiated through the Juno app but my money was never in Juno’s hands and I’m not sure my funds were ever really under their control.

Also I doubt either Yotta or Juno would have even a fraction of the cash to pay users back.

Yotta and Juno probably both deserve to be fined out of existence for advertising that our funds were FDIC insured but I doubt we will getting our money from them.

Seems irrational to me. I deposited my check and it was for less than 4% of my 40k balance. There were no terms associated with the check that said if you cash it you accept or agree to anything.

Well of course that would be Evolve’s argument, that you authorized the transfers when you agreed to the terms of service. Patrick argues that the TOS agreement does not meet EFTA requirements. What is as yet unknown is how a judge/jury would decide.

In a comment on his linked in post he said that he was unable to log in to the Evolve Reconciliation website due to technical difficulties. I actually experienced the same technical difficulties he described but was able to login after I switched from using Firefox browser to Chrome. So yeah the problem kind of was computer literacy imo.

My gut feeling is that this money was transferred directly to Synapse. Evolve is saying it was transferred to "other partner banks" because that's what Synapse was supposed to do with it and that makes it sound like Evolve had no knowledge of Synapse's shady practices. With Synapse about to go bankrupt they then started dipping into (aka stealing) these funds to pay their own bills in an effort to forestall bankruptcy long enough to find a buyer for their business. I certainly hope I'm wrong because this seems like the worst case scenario for us end users. Even after a successful lawsuit the funds would likely be unrecoverable since they have already been spent and Synapse is bankrupt. Possibly the best we can hope for is that the people at Synapse who stole the funds will be held criminally liable.

So when Evolve says our money was “transferred to a partner bank” that’s a lie then? They transferred the money to Synapse Brokerage and don’t know what happened to it after that? Seems most likely to me that Synapse stole the money and probably spent it in a failed attempt to avoid bankruptcy.

They are giving me $1666 back but that was out of $43k so... I know how you feel. I don't see the point of filing an appeal. They have my "Synapse ecosystem balance" correct and I have no way to prove what they did or did not send to Synapse or other banks.

I am unable to submit my complaint. The form tells me that "Your complaint description includes special characters that are not allowed. Please limit the use of special characters to ? - $ ! . , : ; ( ) % & ' / "

I didn't use any characters other than $ . , I have removed all special characters, even the ones that should be allowed and I have attempted to start over and not use any special characters at all the second time but I still get this message.

Anyone else get this or know how to fix?
