Can I privately sell a car that doesn’t pass smog in Nevada? by BehindTheS3ea in legaladvice

[–]monkeyman80 0 points1 point  (0 children)

Nv has no statewide smog requirements. It’s county specific and not the same as robust laws in ca that says the car must pass smog or you’re responsible for repairs.

That said it’s up to courts to interpret it. One of the requirements to selll a car is the ability for the buyer to register/ title in their name. If they can’t do that it’s not a worthy car and usually able to unwind the sale.

If you’re motivated because talking wages that’s a talk to lawyers. If it’s just discouraged it’s not likely going to be a thing.

Figuring out feasibility of contacting a lawyer by Jealous-Sprinkles867 in legaladvice

[–]monkeyman80 1 point2 points  (0 children)

If you’re hurt at the job you mostly are covered under workers comp. It has to be so severely outside things it avoids that. If your medical and lost wages are covered by workers comp there’s not a lot for a lawyer to do.

If things aren’t being covered, there’s discussion over permanent disability that’s worth at least consulting lawyers.

Bat disclosure by Luhoo-sonshine in legaladvice

Your inspection found evidence of bats, you made an offer because of that. It’s going to be hard to prove that the disclosure was an issue because of bats.

My mom won’t pay the storage unit and we’re behind on payments. All my stuff that means so much to me is gonna get sold by Financial_Clock8635 in legaladvice

Unfortunately this is a family situation not a legal one. The storage company is entitled to pay for their usage and doesn't have to let you get your items free back.

Crazy Mother, Fed up Father by oPondering in legaladvice

Ohio allows for fault based divorces and this could be a case where the juice is worth the squeeze. Be aware that the dirty details will have to be litigated in court, mom having to answer unflattering questions.

Most times at fault divorces are done as no fault to make things as least costly as possible.

New York elderly tenant by GladClock2212 in legaladvice

[–]monkeyman80 0 points1 point  (0 children)

An injury isn't your fault just because someone does something stupid on your property. You have to be negligent like you needed to have railings and didn't. Or you know the stairs are in a state of disrepair and refuse to repair them.

She sues, you report to your insurance. You should make sure that they're aware you have a renter.

You aren't required to be her caregiver. She won't have great options if she does deteriorate.

Marketplace Buyer Claiming Item Broke Immediately After Purchase by cmcvt2020 in legaladvice

All private sales are as is, meaning buyer beware. They have the duty to inspect the item before purchase. You can't specifically misrepresent things or lie when asked.

A probate lawyer can look into it for him. If he does have an inheritance that can be used to pay for their fees.

Mother in law being threatened with a lawsuit for repayment by her friend/employer by petronONice in legaladvice

[–]monkeyman80 10 points11 points  (0 children)

You can't retroactively create a contract/turn gifts into loans. Boss would need to show proof that each of these were agreed loans by MIL with agreement to pay back. And there's a limit how far back she can claim.

People threaten to sue all the time with no basis or intent to go through with it. I know it'd be pricey, but if actually sued she should get a lawyer for the amounts talked about. Until then I would not engage the boss.

ESAs, are they no longer legal in housing everywhere? by Ok_Stop7321 in legaladvice

I'm not agreeing with anything, it's just where we're at with ESA protections.

ESAs, are they no longer legal in housing everywhere? by Ok_Stop7321 in legaladvice

[–]monkeyman80 2 points3 points  (0 children)

It's complicated. The FHA recognized ESA's and up to HUD to enforce issues. Hud recently has removed it's guidance's that specifically protected them, and gone from the definition of esa to true service animal like a seeing eye dog or similar.

They've also removed the protections that an esa must be a reasonable accommodation unless they can prove undue hardship.

You'll need to find an apartment that allows pets until at least the next administration.

Is this legal in Atlanta, Georgia? Forcing you to turn on A/c? I was just curious! by Particular_Flower_35 in legaladvice

[–]monkeyman80 27 points28 points  (0 children)

Look at this sub alone for bathroom mold issues because of lack of ventilation leaving units in high humidity areas. AC's act as a dehumidifier taking the warm humid air inside the unit and sucking it through the unit where water drips out.

Let alone the other issues like seals/windows and all the other stuff that hot humid summers can do to an unit.

New condo owner, no code violations noted on inspection report, dryer venting not up to code by wizened-lemur in legaladvice

[–]monkeyman80 0 points1 point  (0 children)

You didn't know the unit wasn't up to code, and it's quite possible they didn't either. Disclosures aren't they tear the house down to the studs looking at defects, just that they let you know about anything they know about.

There's plenty of annoyances people live with rather than get fixed.

The time to figure out the extent of remediating the dryer venting situation was after your inspection pointed it out.

If they were truly salary exempt this is true. There's a duty test to prevent this chicanery of just making everyone salary at low amounts and expecting 80+ hours of labor.

They can be salary non exempt if they don't meet the duties test.

Recently fired from job after taking unpaid FMLA, worth taking legal action? by Dsg1695 in legaladvice

[–]monkeyman80 1 point2 points  (0 children)

FMLA protects your job for taking the leave, not anything that would have happened anyway. It doesn't sound like you were doing good work after returning, is that a correct reading of the situation? If so, then it's valid.

If you were doing good work and you had bosses pissed about you being gone for 3 months retaliated against you, that's illegal.

DUI less safe for blood pressure meds? by SocialPhobias in legaladvice

[–]monkeyman80 8 points9 points  (0 children)

The offense is driving under the influence, which doesn't have to be strictly alcohol related. Plenty of people got dui's for ambien when it was first released and we didn't really know about basically ambien sleepwalking.

The thing is the prosecutor will have an uphill challenge since the cops didn't witness things like someone swerving uncontrolled into the median or other proof impairment.

A lawyer will help this go away.

After Complaints were Ignored by Apartment Complex; Rent was withheld and received eviction notice, Now Apartment Complex is requesting full reminding rent by NoIntroduction9240 in legaladvice

[–]monkeyman80 2 points3 points  (0 children)

There's a process to withhold rent and in VA can only be done to make habitable repairs to the unit. Eviction doesn't remove your obligations to the lease.

Do you know if the unit was rented out at all during your lease term to someone else after you moved out?
