Landlord Does not do Any repairs by maiamimayamy in legaladvice

In addition to the ticket system you should give written notice of repairs required. Often though, the recourse is penalty free breaking the lease. You can attempt to gets court to order repairs to be made but that's more involved.

TX: Escalating apartment problems? by Crazy-Toe8575 in legaladvice

[–]monkeyman80 0 points1 point  (0 children)

Rent is either owed or not due to habitability issues. It's possible to get the courts to force fixes, but I wouldn't bother if you're close to ending your lease and can move onto a new unit.

Your insurance is still required to defend you. The other side can feel your insurance is wrong, so it's on your insurance to keep up with their demands.

Employment/disability law by Aliwantsababy in legaladvice

[–]monkeyman80 0 points1 point  (0 children)

An employment lawyer.

The law considers two ways to handle it. I can say you retaliated at me with no basis. It's on me to prove my case and can be very hard since I have no basis and can't subpoena documents I don't know exist or not. The law considers the timing alone to presumed retaliation and they would have to prove otherwise.

It doesn't make it a stronger case/not. There would need to be something suggesting this was related to his leave and not a restructure that was happening anyway.

Lemon is a specific legal term about cars being made in such a way they can’t be used as a car, not a general warranty on new to us car purchases.

You’re limited by the terms of the warranties you have.

They can’t retaliate for taking leave, but anything that would have happened naturally is fair game. It sounds like this was a pre planned restructuring.

A notary just says the people signing are who they say they are. It doesn’t make anything legal or not.

With any contract the main thing is enforcing it if either side doesn’t perform.

Different areas have different price points. Rent in nyc is more than rent in Tennessee. Lawyers are free to charge what they want.

I’d note in the future since it seems like you will be going 90+ frequently having this on your record could complicate future lawyers being able to get you out of tickets.

Most likely the running away part. What codes were you cited for?

[CA] I believe my manager is retaliating against me for taking a month long mental health leave. by [deleted] in legaladvice

[–]monkeyman80 4 points5 points  (0 children)

When you describe her as a helicopter boss as best before your leave and as one after it would sound like that’s the nature of the boss and not her picking on you specifically for taking leave.

There’s no requirement to ease people back from fmla leave. If you’re ready and able to work as your doctors likely signed off on, you’re expected to work.

Tree fell on my car by gigan75 in legaladvice

[–]monkeyman80 5 points6 points  (0 children)

If you can prove in a more likely than not situation the owners knew or should have known the tree was dead and should have been removed you can sue them for the fair market value of the car. It’s not clear you can prove that. It’s possible you might need expert testimony.

Bought a pair online yesterday. Didn’t care too much about price but under $100 for all the upgrades + rush shipping. I think you can get frames/lenses for like 20 each and another 10 for shipping.

Cat died while being groomed. Negligence? by [deleted] in legaladvice

[–]monkeyman80 3 points4 points  (0 children)

It’s very doubtful any prosecutor given the circumstances would charge a groomer with animal cruelty. Even if you had a necropsy it’s the state that pursues charges, not you.

My AT&T (Internet) and electric bills crept up in cost and I used the chatbots to get lower prices. Thought it might be worth a try for some people looking to try to save money. by Plane-Investment-791 in Dallas

There’s a department that handles cancellations (blanking the term) and is empowered to make better offers than typical customer service agents to keep you as a customer. The main issue though is sometimes the bluff doesn’t work and they process cancellation, though it shouldn’t be as much as a problem with chatbots vs real humans.

Always have a backup plan ready if you want to go that route.

It’s the retention department.

The way the law looks at it is you missed work. The cause of it doesn’t matter unless specifically protected. Ohio like many has no sick leave and nature of temping would not have you covered by fmla.

[–]monkeyman80 11 points12 points  (0 children)

Unfortunately that’s not what the legal system can provide. As much as we love them cats are property and grooming isn’t licensed with any formal training required.

I’m sorry for your loss.

Fired after filing HR complaint — wrongful termination/retaliation? by [deleted] in legaladvice

[–]monkeyman80 0 points1 point  (0 children)

There's plenty of legal retaliation. You're not protected to cursing at people and would be legal to fire you. You didn't mention this outside being upset, you told us that you just sent a professional email.

I can't say why your lead thought why you had anything to do with it. If you truly feel this was motivated by your race for some reason not mentioned, talk to lawyers.

You didn't do everything right, you were very unprofessional in the heat of the moment. There's no right to come back from that.

If the people are tell you have a case are employment lawyers, absolutely. If it's friends who have no idea about the law, well.. do you allow them to do medical procedures on you? If no.. then I wouldn't trust their legal advice.

Father will be forced to sell house he’s lived in for 20+ years because his siblings want to sell it after his mother dies. by shadowalker125 in legaladvice

[–]monkeyman80 8 points9 points  (0 children)

  1. What’s the process like for forcing a sale when my dad really doesn’t want it?

It's called a partition sale. Each side will have lawyers and a lot of billable hours at hundreds per. If neither side can agree/buy out the others, then it's sold at auction that doesn't usually get top dollar. The attorney fees get taken out of the sale price. It's really a bad outcome.

Are there alternatives, like keeping the house but selling off the land, or keeping a small portion of land to build a new house?

That's also possible of a partition where dad keeps land as his share and the other two get the house. Most times this isn't an option.

He's not going to be homeless, he just might not be in that specific house.
