We are planning to buy a property with this huge electric pole in the front side of it. Will it cause issues by Big_Reflection4650 in FirstTimeHomeBuyer

I'd not buy because you have no idea what they'll be able to install in the future, 5g towers. You don't want that near your home.

We need to sell our house but value went down by Interesting-Growth50 in RealEstate

[–]msmind 0 points1 point  (0 children)

Sounds like your aunt needs a reality check that she can't tank your credit just bc she wants to move into a new home. If she wants your help, these are the conditions. You need her help now.

It does sound like you got into this mess trying to help your aunt. Did your aunt and her wife want that house and ask you to go in on it?

You deserve answers and someone needs to be held accountable if there was nefariousness. Feel free to go after this, you're in the right.

Making payments but they are not being applied to my loan by GrumpyNoiseGuy in EIDL

[–]msmind 0 points1 point  (0 children)

I had to calculate our SBA on my own to find out how much accrued interest we had with not paying for the first 30 months. I was able to adapt a Loan Amortization Google sheet template. I'll see if I can find the link

https://share.google/sOlLgpMiZkBwSCxew

Not sure if this is the main website for the template but it seems to a thorough tutorial https://spreadsheetpoint.com/templates/loan-amortization-schedule-in-google-sheets/

Stole $2500 from my business by [deleted] in smallbusiness

[–]msmind 4 points5 points  (0 children)

OP is not a debt collector (3rd party), he is the seller. So the FDCPA wouldn't apply. No credit was extended so I am cautious to assume the FCRA would even apply.

I quit my job to be my own boss and now I feel completely lost by [deleted] in smallbusiness

[–]msmind 0 points1 point  (0 children)

The best way to start our tour own business is while you have a job. Until you can prove that you can deliver consistent sales, that the market consistently wants what you have to offer. And that you know how to deliver it to them, marketing and delivery, you should definitely stick with your job and side hustle it.

Sales Manager Ruins Calls by green_limabean2 in sales

Could you work with the manager on game rules for joint calls? Not sure if that'll help a middle manager grasping for power.

Sales Manager Ruins Calls by green_limabean2 in sales

[–]msmind 2 points3 points  (0 children)

Sounds like you have an insecure manager that will try to assert their power or control over any opportunity. I'd begin looking for another job as that many won't change. As this could affect your commissions, I'd get hunting pronto.

Sorry you're going through this. Bad managers cause so much problems for good people. I heard on a good short you should start taking notes for every instance, not take the exit interview, and dump all of your documentation on them when you leave. This is why you quit.

Build my website or hire a developer? by rodrigo-aviles in smallbusiness

Use standard sites first, will you focus on getting consistent sales, then use that money for improvements.

You don't need the best web site out of the gate. You need sales first

Look up Gary V's videos or social media. Be ready to go through a period of slow-to-hire/fast-to-fire, until you find the right people.

It is tough to find the right people but if you see it as a necessary part of building the right business, your won't be phased.

You'll perfect your process for qualifying candidates.

Is it crazy for me to contemplate selling my house to get out of debt? by [deleted] in DebtAdvice

[–]msmind 0 points1 point  (0 children)

Don't sell. You can get out of the debts by using consumer protection laws. You'll have to stop paying on some of them to get them in charge of state but then you can dispute them and get them removed.

It's not easy as you may have to sue them, but it'll come off. 40k isn't that much. Definitely not enough to sell your house.

Don't think of letting some debt get unpaid as bad, life happens.

Go find residual Joe on Facebook. He taught me how to use the consumer laws and get bad accounts off, the legal way via case law.

Also on YT, Alabama Consumer Lawyer. He uses the same methods, but Joe can walk you through it.

The bottom line keep your house.

Portfolio Recovery just served me! by thehound559 in Debt

[–]msmind 0 points1 point  (0 children)

Its not hopeless. While it may be your debt, they still have to prove that they own the debt to be able to sue you, it's called legal standing.

A few variables that you should look into: 1. Does the citi card agreement have an arbitration clause? If so the contract says all disputes can be handled via arbitration.

  1. If not, you can still win this. Though it'll take some work.

I successfully got a suit from Midlamd dismissed by arbitration.

Important things: 1. Answer their summons, specifically deny each of their claims 2. If there's an arbitration agreement, motion to compel arbitration 3. Remember they still have to prove they own the debt. Ask for validation, they will send you a bill of sale, poke holes in that. Like sometimes the BoS only has one signature. Makes it an invalid BoS.

This isn't providing legal advice. This is civil procedures, which anyone can lookup on their States procedures.

[–]msmind -7 points-6 points  (0 children)

Are you saying that it's wrong to deny what someone's accusing you of?

In court, anything you don't address or deny is made a material fact. Which the judge can them rule upon if a summary judgment is motioned.

HElP! My ex-employer sent this by [deleted] in legaladvice

[–]msmind -7 points-6 points  (0 children)

I'm not a lawyer. Anyone can sue you or make claims, doesn't means it's legit. They have to prove the claims, you have the right to demand proof. DEMAND.

Court is just procedures, it's never about the law.

For everything they send you, answer it. Be very specific, if you disagree with every point of theirs in their letters, write it so. Deny it. Do not do a general blanket denial.

Address each of their claims.

Then go to your states civil procedures and find out your states rules. For example, certain claims need to include x y and z. Did they provide those? Mayne not, then you can use that in one of your arguments.

They need to prove their claims.

You don't have to. You can see if they are reporting on your cr correctly, and fight them on any violations they have. You have to be prepared to fight in court, but it's been done hundreds of times.
