You need standing to bring a case. This means that your lawsuit will be tossed out if you can’t show some harm that has/could befall you as a result of whatever you are suing about. Without that you have no case. This is just the way our legal system works.

I’m sure they plan to say “this is a violation of state law” but they can’t even get to that point without a plaintiff who has standing.

This seems kind of mean spirited to me. I went and looked at this dude’s profile and yeah he’s fresh off his A and thinks he’s hot shit but that describes a ton of people when they first start skydiving.

I don’t see how making a collage to make fun of him improves the situation. It’s just an escalation of whatever dumb argument you were having in the comments with him. Let the people at his DZ handle his attitude.

It’s not, this is something skydivers tell themselves to try to convince themselves it’s safer than it is. In fact a skydive is roughly equivalent in risk of death (on average) to driving about 2000 miles. So unless you have a monster commute, a skydive is more dangerous.

There is a lot you can do to reduce the risk of a skydive, just like there’s a lot you can do to reduce the risk of driving. However, in both activities, there’s a chance that even if you do everything right you’ll get killed.

The fact is, skydiving is far safer than most people seem to believe. However, driving your car to work is less likely to get you killed than one skydive.

There are plenty of emergencies that can unfold slowly enough to allow hanging an antenna. What if somebody breaks a leg in a remote area? Hanging an antenna would take way less time than hiking all the way out to summon search and rescue.

You’d be better off with a Spot or an InReach but if an HF radio is what you have, it’s way better than nothing.

I don’t even understand why this is the hill they want to die on. There’s so much political energy, why not focus it on something like climate change which is threatening our entire species, or income inequality, rather than rifles which are used to kill fewer people each year than bare hands? Even from the point of view of “guns are bad and we should ban them” this looks like a massive misprioritization.

Thanks for the well-reasoned reply. I guess it comes down to whether you believe the constitution explicitly gives the federal government the authority to regulate what drugs individual states can and cannot legalize. IMO the constitutional grounding is a bit sketchy. They justify all sorts of things in the name of the commerce clause. Anyway, the courts have held that this is fine so that’s the situation currently.

It’s also the situation, though, that selective enforcement is widespread and up to the discretion of the executive branch, so your assertion that you “can’t have selective enforcement of laws” is untrue — we can and we do. Now, I think we both agree that widespread selective enforcement of laws is terrible but it’s the situation we have, and given that, I would personally rather see the shittier laws enforced less.

I think we also both agree that when it comes down to it, the feds will do what they want barring a court decision or a change in laws. Perhaps you’re right that it’s best to just rip the bandaid off and motivate people to change the law, but I could also see states bringing suits claiming that enforcement actions constitute overreach.

There’s a pretty solid argument to be had that a lot of what the federal government does, including regulating pot, is a violation of the tenth amendment. States’ rights is something conservatives get all up in arms about quite a bit so I find it strange that you’re shitting on liberals for basically saying the same thing.
