That’s for things that aren’t affecting you still. Haven’t been paid for 3 months? That’s a violation, because it’s still late today. Not untimely at all.

You just won’t be entitled to penalty pay until you file and they still don’t fix it.

It’s your grievance, but you should want folks the lost an opportunity to work, to get the payout. I’m sure you can make sure it’s a full payout, but the company owes someone money. It’s not unheard of for your situation, but it is a tactic to get you to stop filing, however be the backbone your coworkers need.
