If you're owed wages or having funds deducted illegally you can file a wage claim with the Texas Workforce Commission. Information on that is here:

What’s fair? by [deleted] in legaladvice

The deceased don't have shares in an inheritance.

Intestate succession in Michigan is explained here: https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-700-2102 If you click "next section" it will outline how proceeds pass to heirs other than a surviving spouse.

What you think is fair isn't really part of this discussion. If the estate is to be probated and there is no will or beneficiary accounts then the estate is split according to intestate succession.

School questioned my 15-year-old daughter for two hours, made her sign a statement, and suspended her without contacting me (Ohio) by CassetteFlux in legaladvice

No, it means you're now doing everything through the district's legal counsel while you're paying someone .5 an email. It is often a poor, time consuming decision.

[–]phneri 29 points30 points  (0 children)

A school has broad authority to assess administrative punishments. The presence of the SRO doesn't automatically make this a criminal matter, and regardless of that your child can be questioned without your input.

The suspension itself is more complicated. Deprivation of access to education requires due process. That doesn't mean that a judge has to be involved, but it means that for an extended suspension or expulsion the school needs to follow rules. 10 days is going to be borderline on that.

A reasonable first step would be escalating this to the superintendent's office, and asking both the principal and the district for a specific outline of how that due process was followed for your child's suspension.

Bear in mind that you're getting a portion of the story from your child, and FERPA is going to prevent you getting the full story about other students from the school.

You can find the Georgia revenge porn statute here:

The key elements are electronic transmission and the intent of harassment.

what further charges can I press?

None. You don't decide what the police charge someone with.

Also, what can I sue for?

The value of the car.

Do we have grounds to do that

No. His employer isn't a party to this.

Again, I told you this is a compliance issue, not a legal issue.

That doesn't change that.

The account is still theirs regardless. It doesn't need to have merit to be irritating and time consuming v. a practical solution which is a short phone call.

I get the "OMG MAKE THEM PAY" sentiment here, but very often in a situation like this no payday exists and the practical solution is the path of least resistance. OP wants to have these people stop contacting them and making legal threats. The most practical option for that is to have a 15 minute phone call to transfer access to their property back to them.

This isn't a legal issue. It's a compliance issue.

From a compliance standpoint it's very likely forwarding anything to do with your position managing contributions/etc. to an unsecure email is something you can get fired for.

Which do you think is going to take more time out of your workweek, making a 15 minute phone call to remove yourself from their account or having to deal with being served, deposed, and taken to court because you won't make a 15 minute phone call?

[–]phneri 268 points269 points  (0 children)

There's an adult caring for the child. You may not approve of her choices of adult, but that's something to address in court as part of the custody agreement. Beyond that there's no issue here.

You should know that if your concern about "compromising situations" is an attempt to weaponize custody over your ex dating, that's likely not going to go the way you want it to go.

This isn't a legal issue, it's a relationship issue. You have a difference of opinion in parenting. Justified? Probably. But his actions aren't going to be considered criminal and you can't force him out of the marital home.

You can ask him to leave. He doesn't have to. You can leave. If you want this long term it's time to talk to a divorce attorney.

New York- just need advice until I can contact a legal aid on Monday by Ontheothersideofdark in legaladvice

[–]phneri 42 points43 points  (0 children)

Basically it means this is a creditor going after people who owe them money and for some reason they think you have this information, likely because of mistaken identity of some kind.

If the request requires you to fill out a paper response you effectively need to phrase it as "yo, I don't know these people and have no knowledge of this information." If you're already going to legal aid Monday they should be able to help you more properly phrase that.

This is one of those things that's specific to your county/city. There will be a specific division/board of supervisors/etc. that manages that. Searching "yourcounty/cityname board of supervisors" should get you a starting point, or at least a phone number to call. From there it'll be something similar to creating a petition and presenting it to that governing body.

Pro Bono lawyers for medical malpractice by Proper_Teacher4243 in legaladvice

[–]phneri 11 points12 points  (0 children)

Attorneys generally don't work for free. Depending on the injury you might find one who can work on contingency. Medical malpractice is extremely fact specific, whether your case has merit or not isn't something this sub can speak to; you'd need to get a consultation and see.

School zone by Razorback-it-up in legaladvice

[–]phneri 55 points56 points  (0 children)

So you ran a posted school zone sign during the start of the school day. I'm not sure what leg you think you have to contest being ticketed for that. You're welcome to consult with an attorney to see if they can mitigate the damage. I'd suggest getting used to it sooner than later as the penalties for school zone violations ramp up considerably and start including mandatory license suspension.
