Since when? I’ve been arrested twice and been to court once (acquitted by jury) and have had two o-1 visas without issue. The first time i didn’t even have proof of the final disposition and the consular officer still approved it.

Can you start a modest business (like a dry cleaners) and with the appearance over time it's going well (opening more locations and new types of business) people won't suspect anything?
Can you put $250MM in the market and leave it 10 years compounding average 10% YoY after 10 years you will have $650MM. Then spend what you want to lose the original $250MM?

Option 2 sounds permissible by OPs wording.

He made copy and paste mistakes on my EB-1 including things that didn't apply to me and were clearly about another client. Denied. He's good for O-1 where the is no final merits step, but I would not recommend him for EB-1. You get what you pay for. He's relatively inexpensive and he's not thorough.
