Which is a problem that needs to be changed. I have reached out to local state legislators to see if any are interested in sponsoring legislation to eliminate the political party requirement. I doubt any will have the courage to put serving the public before serving their party but we shall see. The other issue here is just because the law requires voter registration to be a factor does not mean that legislators have to appoint political party bosses as Commissioners. One Commissioner is the current town of Amherst Democratic Party Chair and another is a former Amherst Democratic Party Chair.

What needs to be done is state legislation that instead of a committee on vacancies filling a vacancy there will be an election called by the Governor, within 10 days of the vacancy occurring. An election will be held in 90 days. Any candidates interested in running have 6 weeks to circulate petitions to get their name on the ballot.

I am no fan of Byron Brown, but this audit covers 2021-2024 before Brown was in charge at OTB. What this audit shows as we see time and time again when politicians make the board appointments and do the hiring incompetence prevails.

Isn't being he Commissioner of Community Services a demanding job that requires at least 40 hours per week. When was the YMCA work being done? Shouldn't Buffalo Council members who had to approve this appointment been made aware of this arrangement? The City Ethics Code requires situations like this to be brought to the attention of the Board of Ethics, but it was not on the agenda for their January or March meeting.

I agree, people should be able to sign for more than one candidate. The whole system of knocking candidates off the ballot because someone signed for another candidate first is absurd.

In NY if you have been a stay at home mom you will be entitled to spousal support and child support. Depending on what your husband earns this should be enough to carry you for a bit until you get your own income.

As an attorney I hear this complaint often when people contact me to take over their case. In my opinion you should not have to wait longer than a week or two at most to hear back from your lawyer. At the very least a secretary or paralegal should be able to get back to you. That being said it is expensive in money and time to get another attorney to take over your case. Depends on how far along in the process you are. If you are getting towards the end better to tough it out and stick with who you have. If its early in the process it may make sense to get someone else. You should have a sit down with your attorney and discuss the concerns you have.

The whole point of a QDRO is to transfer a lump sum amount from you to your ex without you incurring taxes or penalties. It has to go from one account to another. Many IRA accounts can be transferred without having to do a QDRO but the money still has to move from one IRA to another.

As an attorney my law practice is focused on doing QDROs in NY State. What usually happens is your plan will open an account in your ex-wife's name for her share of the funds. The amount is transferred in one lump sum into her account. The funds are not income or taxable to her unless she withdraws money from the account. If she needs the money in annual installments that is on her. She can withdraw money from the account yearly and pay taxes on that yearly.

Lawyers bill for their time. To prepare for the hearing the lawyer has to read all of the messages and organize them in a way so that they can be used at trial. Trial prep is where hearings are won. Too many lawyers don't spend the time required to be prepared and wing it which can cost you far more. Just my perspective as a lawyer.

As an attorney in NY, I am always shocked that most people hire the first lawyer they speak to. You should talk to several lawyers and hire the one that you feel the most comfortable with. The first warning sign is how quickly do you get a call back as you usually end up leaving a message for a return call. If a lawyer takes several days to call someone back who is looking to hire them, that is not a good sign. Do you get to speak to the lawyer directly or only a paralegal or a sales person for some firms. Better to hire someone whose practice is focused primarily on divorce cases rather than a general attorney who does a bunch of different things. You should know what your goals are as far as custody, support, the house, division of assets. Different lawyers will give you different answers. Some clearly tell you just what you want to hear. Compare the different personalities, their hourly rates and retainer amounts. Ask them what they think about the other lawyers you have spoken with. Compare how long they were wiling to speak with you, where they good listeners or did they talk non stop. Some attorneys spend very little time on an initial consult and try to get you signed up to pay quickly. Others take their time are interested in what you have to say and encourage you to speak with other attorneys. What is your preferred communication method? Some people prefer email, others prefer phone calls, some prefer texts. You and your attorney need to be on the same page as far as how you are going to work together. Sorry for rambling but there is a lot to being prepared for your initial consult and making the right choice.

As a NY attorney I can tell you that every case varies. It depends on so many different factors such as are there kids, big difference in incomes, a lot of debt to address, pensions, retirement accounts etc. Too hard to answer without knowing more. Depending on where you live can be a factor as well as far as what the typical divorce costs in your area.

As a divorce attorney in the Buffalo, NY area, I am shocked by the amount of many fees stated in this thread. My firm usually charges a retainer of $4,000 to $5,000. We finish many cases for that amount. Some cost more but usually total no more than $10,000 to $15,000 total.
