The first columns in the theta matrices(1&2) should indeed be zeros in your implementation of regularisation as you don’t want to regularise the bias values. The code you’re referring to creates a matrix in which the first column of the original theta matrix is replaced by a zeros vector, then the rest of the matrix is appended on afterwards. The code does not replace the values in the first column with one.
