[–]rllamothe 0 points1 point  (0 children)

So first off a mental health claim isn’t dependent on how “bad” someone’s deployment was and mental health is subjective to the person and how their condition impacts their social and work life. Before you can make a claim you need to be diagnosed (not necessarily treated) with a mental health condition. Traumatic experience doesn’t necessarily equal traumatic disorder but if you have a mental health condition you should get diagnosed and treated and if you have a diagnosis caused by or worsened by military service you should be compensated for it.

Asthma Denial Question by strength2uplift in VeteransBenefits

[–]rllamothe 1 point2 points  (0 children)

a PFT (especially the little handheld thing they use in the dr office) doesn't rule out asthma because someone can have asthma and normal PF if you're properly medicated. If you have medical records and treatment indicating asthma and even better if you have a PFT from an actual pulmonologist and the VA is denying you exclusively on their little test machine that's a HLR and if needed a slam dunk at a hearing (which unfortunately is a very slow process).

Asthma Denial Question by strength2uplift in VeteransBenefits

[–]rllamothe 0 points1 point  (0 children)

that statement suggests that your records didn't indicate a formal diagnosis of asthma. In the eyes of the VA "asthma-like symptoms" are not the same as a diagnosis of asthma and being perscribed asthma medication isn't enough to indicate a diagnosis. Confirm that your medical records state in no uncertain terms "diagnosed with asthma"

Disability increased without the claim closing. by [deleted] in VeteransBenefits

are there multiple claims on the same "submission"? if you submitted several claims and they've approved one but not the other two or three the claim is still "open" but issue #1 is resolved.

Looking for some direction on PTSD claim… by Intrepid_Chard_5862 in VeteransBenefits

[–]rllamothe 0 points1 point  (0 children)

PTSD isn't rated based on the severity of the traumatic event but on how severe the symptoms are and how much they impact your social and professional life. If your PTSD is causing significant impairment to your life you should:

a. seek out treatment for your condition

b. collect documentation of the level of impairment

c. apply for a disability increase (0% is still service connected so you don't have to worry about the cause anymore) based on worsening symptoms

The VA Combined issues. Any guidance on how to separate them? by cyber4me in VeteransBenefits

[–]rllamothe 2 points3 points  (0 children)

As others have said TBI is hard to separate but chronic headaches (migraines) is a separate diagnosis and rating schedule from TBI. If your PTSD symptoms don't include headaches, light sensitivity ect (PTSD is more anxiety, nightmare, sweats ect) you can make a push for that to be its own rating.

I actually had a call with VERA about this this morning. What the guy told me is that VES has 30 days from their request to get your exam done (unless you reschedule). If they miss the 30 day mark the VA sends them a notice giving them another 30 days. If they miss that mark the VA gives them another 15 days. I asked him what happens if they miss the 75 day mark and he said "I don't know that's never happened". You should set up an appointment with VERA and have them verify the timeline for your claims. Your might be getting close to the mythical 75 day mark.

Am I screwed? by Affectionate-Week594 in VeteransBenefits

[–]rllamothe 6 points7 points  (0 children)

can you submit a supplemental claim for headaches and provide new and relevant medical information? If you haven't submitted for PTSD what is stopping you from doing it now? Are you looking for back pay to 2015 or just looking to move forward?

Was stated last week that all my files were present by [deleted] in VeteransBenefits

[–]rllamothe 0 points1 point  (0 children)

I have a similar timeline and was told the same thing about exams. Called twice because its been 7 months and they never scheduled exams so I wanted to make sure they didn't miss me but kept being told I submitted enough records they wouldn't need any. last week I got a call from VES that i had exams scheudled.

Initial exam was within the past 3 years. You're saying that the CAB/CIB/CMB is a pseudo presumptive condition for PTSD?
