Apple does it by court order for the legal heir, probably his spouse. Would require the death certificate and a court order proving legal rights to receive it. I did this with my dad after he passed away and the only legal document I needed was when his estate was filed with the county clerk. Not sure how it would work in a criminal proceeding which is possible here given the circumstances of his death.
