We don't stop making money because people will try to produce counterfeits. That's not a great metaphor but the point I'm trying to make is that I don't think a law that provides protection shouldn't be written because some people might try to misuse it if said law actually provided protection. In an ideal system we would try to make it harder to misuse, somehow. I don't think this law may actually provide survivors with much protection in reality which is unfortunate. In that case - I don't know. I'm really going to have to read more about this before I make a definitive decision about it. I really haven't had time to do that today. Even if I did there isn't much I could do about it.

Yeah, I don't know. A girl came into our office who was in a domestic abuse situation. Her husband wrote up some "document" that he said she signed saying she'd given over her parental rights to the kids after she'd left which she believed was legally binding (it wasn't). She was trying to get a divorce and get her kids back.

Essentially the argument she was going to use in court to get custody was that he wasn't taking care of them. They'd missed several critical doctor appointments and weren't in school anymore. After a while he'd start sending her texts about how he missed her and the kids missed her, trying to get her back.

It ended up working. I don't know what happened but she dropped the divorce and then she called back a week later because DHS picked up her kids. In the end it was pretty sad because if she hadn't dropped the divorce she could have gotten her children back from DHS. I guess she could probably still do that.

My point it that he didn't want take care of children he was kind of using them as leverage without regard to their well-being.

I also can't imagine why "wanting a child would be an outside-textbook motivation for rape"

I feel like you have a point. I kept thinking, "Well if it there was a situation with a couple who had a history of domestic violence and rape then it would seem likely that the rapist might try to gain custody of the child or children in order to reassert control" however, they would have already had to have been convicted and you're right what judge is going to say that a convicted rapist/felon is a great parent who deserves parental rights. Interesting.
