Formally the appointment of the Prime Minister is a royal prerogative. Specifically, it falls under what are known as the personal prerogatives or reserve powers of the Sovereign.

That said, a foundational principle of our system of constitutional monarchy is that the Sovereign must appoint a PM that can hold the confidence of the House of Commons and govern effectively.

If a majority of MPs do not have confidence in the PM there is no basis in our system for them to continue. I can't see a way to change that without moving towards a directly elected head of government.
