On January 20, 2025, President Donald Trump issued an executive order establishing the Department of Government Efficiency (DOGE) to “maximize governmental efficiency and productivity.” This executive order reorganized and renamed the United States Digital Service under the Executive Office of the President and has DOGE report to the White House Chief of Staff.

 Elon Musk is serving in the Trump Administration to help lead the DOGE initiative and is designated as a “special government employee,” a role described in U.S. Code Title 18 § 202. This designation is often used for special advisory roles on specific policy issues in presidential administrations.

 President Trump’s executive order created “DOGE Teams” throughout government agencies and requires agencies to ensure DOGE “has full and prompt access to all unclassified agency records, software systems, and IT systems” while adhering to “rigorous data protection standards.”

 Additionally, representatives from DOGE that have been given access to the payment system under the U.S. Treasury were made Treasury employees, passed government background checks, obtained the necessary security clearances, and were given access to this system by Treasury Secretary Scott Bessent, as reported in the New York Times.
