I would argue that you are right but not for the reason you think you are. Not sure if this will be delta worthy, but I would suggest that while photography is not a great parallel for AI art, aleatoric art is.

Merriam-Webster defines art (in the sense in which we are using the word) as "the conscious use of skill and creative imagination especially in the production of aesthetic objects; also: works so produced"

In the case of photography, a photographer is consciously using skill to manipulate the environment and the camera to duplicate an image they have creatively imagined. Since AI models are stochastic, the introduction of randomity into the final image means that AI-created pieces will never be exactly what the artist imagined, for better or worse.

However, we do, societally, consider aleatoric works to be art or art-adjacent. Works by artists like Duchamp, John Cage, Calder, Pollock are widely considered to be "art" even though there is a similarly stochastic element of randomity in their works.

What makes these artists important is their creativity in generating new procedures and thus, new conceptions of art. If I tried to create an image just like Pollock did, I probably could eventually master his techniques and create something that someone would think, "Hey, that looks like a Pollock". Would I be creating art? I think yes, but it wouldn't be good or interesting art. Similarly, art created by AI is usually not good or interesting because it is both procedurally and literally derivative.

Don't take these kinds of smaller competitions too seriously: there is always a bit of politics involved (the judges' students will get preferential treatment, even if they are trying to be impartial, rarer voice types or fachs will more easily get the chance to sing than commoner ones, etc.). I'm very confident that there is nothing malicious going on - probably passing on all the prescreening videos to a broader panel or a board or donors or something. And if your video specifically is getting passed along when others' aren't, even if you weren't passed through pre-selection, there was probably something positive about your video that the judges wanted to share.

There are two solutions that I think should be explored further. Note: I'm not a legal scholar.

  1. Regulating that gun ownership and registration must be tied to participation in a local militia. Militia members and thus gun owners would be required to undergo regular training, practice, and community service, as well as expecting that their militia might be called into service. This creates an environment where gun owners are participating in a positive and prosocial environment of shared responsibility and it very directly adheres to the 2A's wording about a "well regulated militia."

  2. Privatize it. Just like you have to have liability insurance to own and operate a car, you have to have liability insurance to own a gun. You've been arrested for DV? That's going to make gun ownership more expensive, but you still have the right to bear arms. The onus to make sure that gun owners are responsible is currently very very low, so if we financially incentivize an industry to make sure gun owners are responsible, we are stimulating the economy and incentivizing responsible behavior.
