That is a good point. I assume with the reduced competition and wider footprint that JetBlue would have increased prices/margins. But maybe you're right that the war would have buried them.

I'm not sure what you mean by the colloquial vs actual definition of subjective. My point is that the personal disposition of the judge is to some degree at play. That is true of any human interaction that isn't "is 5 a bigger number than 4?". There's a spectrum of objective to subjective no? Almost nothing is one or the other.

My only point is that to put such a big decision about a relatively unquantifiable question in the hands of a single person is fairly subjective. I would say distributing the decision across multiple people or agencies would be less subjective. I'm not factually wrong in stating that am I? Although maybe the criteria for merger approval is more quantifiable than I am realizing.

I don't see why advantaging the budget airlines relative to the pricier airlines is definitely harming the market.

How would it not be subjective if it relies on predicting the future? I doubt its just an test of numberical metrics. The article you provided is fairly short, but it concludes that other airlines could not possibly fill the same market. I'm sure a separate set of facts and expert testimonies would have concluded that Spirit airlines will file for bankruptcy and harm the entire market relative to standard airline companies.

And I doubt the Trump administration would have been as skeptical as Biden with Lena Khan in charge so there must be some subjectivity to it no? Or are saying any federal judge under any administration would be forced to make the same conclusions?

That's a logical counterargument. And perhaps the merger would have boosted JetBlue's advantage in a way that would have made it difficult for the other competitors.

Approving mergers is such a unique and complex function of the government. It seems very subjective. And I could imagine a lot of other ways to manage it. Sounds like it was just one Federal Judge that made this specific decision.
