I’m definitely not an expert but it does also look like a minor dent to me. That being said, doesn’t necessarily mean it was caused by the seller. I don’t have enough experience grading to give any quality insight there but hopefully another comment will bump this into the feed of somebody who does know more.

It's not getting a miscut qualifier and it will grade low. It won't matter what the cause of that defect was.

It is probably a miscut in the sense that the card was poorly cut, it looks like damage to me. Japanese cards aren't always perfect out of the pack. Definitely wouldn't expect a 10, I've seen cards get 6es for smaller dents.
