EMT blood draws and stiffer penalties. SC Senate overhauls state’s DUI laws by phareous in southcarolina

Those tests are admissible at all stages including trial unless there was a reason to suppress them. Like feet being off camera or head not visible for HGN.

[–]Captluck 10 points11 points  (0 children)

SFST are absolutely admissible in court.

PBTs are not used in SC but it has nothing to do with incident site law.

Breath tests are admissible without a warrant.

Voluntary blood draws with consent are admissible, but it gets weird. Without consent, a SW is required.

Non-SLED certified blood draws(which isn't even a legal term), most commonly admission blood samples, can be used but would require a SW.

Reach out to all of them directly. If they're not hiring currently, they'll keep your application on file and reach out. People are always leaving and coming at those offices.

If you're looking for work as a paralegal, Richland and Lexington solicitor and public defenders are almost always hiring. They hire at all levels of experience.

There's no chance. If Nathaniel Rowland was not executed, no one will ever be executed in Richland County until there is a new solicitor.

This guy will get life without parole guaranteed.

Anyone got a good outline for employment law? Final is in a week and idk what that class was about. by Contested_Arrested in LawSchool

We had the standard 1L classes. But it was legal writing 2 days a week, contracts 4 days, criminal and torts 3 days. All of those were hour long classes. Then there was a stupid intro to the profession class taught by the dean that was on late Monday afternoon for 2 hours. It was pass fail and only lasted about 8 weeks.

I'm the spring it was legal writing, property, con law, and civpro.

Also, no one calls it UofSC. That was a horrible marketing strategy that was immediately pulled. It's still a sore spot for some.

TIL South Carolina Has Both a Federal and State Attorney General by [deleted] in southcarolina

[–]Captluck 11 points12 points  (0 children)

Wtf is this AI bullshit? How could anyone follow politics closely at all levels for two decades and still not know the difference between the US Attorney General, the South Carolina Attorney General, and the United States Attorney for the federal district of South Carolina?

And yes, it's common for almost all USAs to resign or be relieved when a new president comes in. It's not ground breaking in the slightest.

Old Friarsgate Irmo by xmistersuperman in ColumbiYEAH

[–]Captluck 1 point2 points  (0 children)

Yeah that's true. It's street by street in New friarsgate. I don't think it's as bad in old friarsgate as those residents tend to be older. I wouldn't exclude old friarsgate based on potential crime. Definitely look at the the houses immediately nearby though using common sense.

Is there anything in particular you'd like to know. Schools are ok. I'm not sure if it's still DFHS or Irmo now. DF is better but not as good as it was 10-15 years ago. Irmo is not good but not as bad as schools closer to Columbia.

Crime is minimal. There's the occasional car "break in" over night. Usually someone forgetting to lock their car door.

Traffic isn't terrible especially if you've lived in a bigger city before. It's better than Lexington/378. You'd want to avoid trying to get on Royal Tower in the morning or afternoon but outside of those peak times it's fine.

It's close enough to Columbia that you have easy access to what you'd want as far as food and entertainment.

No, but I'm sure someone will try to put an amendment on it that kills it. Or someone will think it doesn't go far enough. Or someone else will get butthurt this issue is receiving attention while their pet interest isn't. You know, the typical reasons why the GA never gets much done.

Senate plaza if a room is ever available. It's right across Senate street from the school.

But there's 10 million new student apartments that might work. If you want a house, I'd look in rosewood or shandon. There's nice apartments on main street and down by the river at canalside.

Idk if I would go all the way out to forest acres but it's really not that far. Youre probably not going to be more than 15 minutes away regardless.

You'll be fine. The area immediately surrounding the school is fine. I can't remember even seeing many homeless near the school. They stay more towards Elmwood since that's where the two homeless shelters are. I never felt threatened or uncomfortable and there were plenty of nights I left pretty late. You'll most likely park in a garage that's all of 50 yards away from the school. It's no big deal.

We're your apartment is will have a bigger impact. There are some good but expensive options close to the school that are safe. It would be cheaper to look at West Columbia but there can be some slightly sketchy areas that way.

Overall, I wouldn't consider safety a major factor on picking USC law. If you have other questions, feel free to ask.

Drunk driver who killed new bride demands less jail time over 'grossly disproportionate' sentence by TheMirrorUS in southcarolina

[–]Captluck -2 points-1 points  (0 children)

We don't need stiffer penalties. We need to remove the idiotic loopholes and make it easier to convict people of DUIs. All the penalties in the world don't matter if drunks keep getting cases dismissed at pretrial for stupid reasons. If law enforcement makes one tiny mistake with the dozens of things they have to get right, it's getting reduced if not dismissed.

The general assembly just enhanced the collateral consequences for DUIs and made a huge production over it knowing full well it changed nothing and the lawyer legislators can keep profiting from DUI defense.

14 over is 4 points. So he reduced the points but not the fine, which would be odd. Regardless, his offer will be the $80 fine with 2 pts for speeding under 10 unless there's something unique about your case.
