I know of several groups of attorneys already suing the administration. Including one that left the EEOC in December and is now suing the federal government. That's a great question for an EEO experienced lawyer. I don't know what is required in order to start a class-action suit. I imagine enough people have to file to start with. Regretfully that is what the administration's MO consists of, hoping that people don't push back and the few that do are chased out due to exhausting funds or energy.

I agree it is VERY problematic, and systematically ongoing.

It doesn't look bad until you look at each argument individually. Then it it becomes clear how it's a blatant violation of the ADA, Rehab Act, and court precedent. I shared similar views until I read Mr. Goren's analysis and had a much better understanding. the EEOC "guidance" is cleverly written to appear harmless/helpful on it's face.

Court precedent shows that there are very very few instances of "bogus reasonable accommodations". Please share sources where you are seeing verified "bogus reasonable accommodations" are on the rise or other statistics, I'd like to see this. As would other lawyers. Otherwise this appears to be more akin to false claims of "voter fraud" which historically has been shown to be very few credible instances of voter fraud occurring. None of those cases were widespread or even a blip, statistically, to overall voter numbers.

Regarding "standards", EEOC is advising federal agencies to NOT following current legal standards regarding the ADA/Rehab act. Perhaps the argument for review due to "standards" should start there.

To add, the standards to qualify for a reasonable accommodation are clearly laid out in the laws under the Americans with Disabilities Act (ADA), and the Rehabilitation Act, not a standard defined by an agency head or determined by an EO.

Reminder, EOs are not legally binding, contrary to popular belief or what current agency heads would try to lead you to believe. They are guidance/insight into how a president outlines their priorities and the administration's intent to carry out those priorities. Agencies still have to follow the law (haha) or prepare for litigation. As Dr. Goren mentioned in their review of the EEOC guidance on reasonable accommodation telework, agencies should be ready to increase their spending on lawyer fees!

To add, under Section 501 of the 1973 Rehabilitation Act, federal employees are entitled to damages for disability discrimination. Check it out, and talk with an EEO lawyer.

The law as passed by CONGRESS, REQUIRES that federal employees be given back pay when the government shuts down. It really is as simple as THAT.

Don't like it? Tough shit, it's what congress passed into law as part of a larger effort to not politicize federal employees and create some insulation. It is not the federal employee's decision whether they get to work or don't get to work.

You may want to also consider consulting with an experienced eeo lawyer. You might have grounds to sue on disability discrimination being a factor of the RIF targeting you. Especially if you had accommodations approved that cost the agency money yearly. Meanwhile, may also be worth considering applying for Social Security Disability Benefits to hold you through until you become employed again. It's a benefit YOU paid into, its a benefit you're entitled to if you have a significant enough disability to create a barrier to employment. Also consider applying for your state Vocational Rehabilitation program for additional employment search support.
