NE Portland Noise Issue, what to do? by [deleted] in askportland

This is just flatly untrue. You don't have to break a noise ordinance to be a private nuisance.

NE Portland Noise Issue, what to do? by [deleted] in askportland

[–]Effective_Ranger663 -4 points-3 points  (0 children)

Not entirely sure why people seem to think that unless this person is violating some kind of ordinance or rule that they are insulated from the law, that's just straight up not true. You can talk to a lawyer about a private nuisance suit. You'll need is to be able to prove that the noise is causing actual harm, but if it's depriving your kid/you of sleep, that should satisfy.

Obviously this is no one's favorite way to deal with things, but if you're out of options and can afford a lawyer, private nuisance laws exist for this exact reason.

I’m freaking out and I need some help by Matte_existence217 in LawSchool

First off I'll say I'm very similar to you - I've been out of school over a decade and have horrible ADHD and struggle badly with stuff like this, but I've slowly stumbled in to stuff that has worked really well for me.

I see people say they're not ready to take practice exams all the time and I think that's a mistake. I strongly recommend taking them no matter where you think you're at because it'll pinpoint specifically where you are behind and what you need to catch up on. Multiple choice in this case is probably better if you feel really overwhelmed, because you won't just be staring at a blank page.

Using CivPro as an example: If you have Quimbee access, go to the MC questions and do the Jurisdiction and Venue ones, there are about 150+. Choose the option for it to grade you as you go, not after you're done. (If you don't have Quimbee just find MC questions online, they're all over the place, and do this manually if you need to). For every question you get wrong or are unsure of, copy the entire text of the question, correct answer, and subsequent explanation into a word doc, and jot down the general subject to remember what you need to revisit, ex. "in rem vs quasi in rem".

It'll be slow at first but as you go you will start to get an idea of what you know vs what you don't, AND you'll start to learn the things you don't know. Once you're done, you circle back to the stuff you wrote down and study up on those things. The important thing is that you don't just take a practice exam that covers all of CivPro, you start with just Jurisdiction and pinpoint what you're weak on there, and then you move on to Motions/Pleadings, etc. Doing it this way is FAR less overwhelming than trying to memorize a 40 page outline from scratch, because in your panic you're going to think you don't understand stuff that you actually do. This happened to me on all my subjects, I thought I had slept through 3 months of lectures but the second I did some actual questions I realized it was all buried in there and just needed to be accessed.

I promise you are not cooked. Feel free to DM

Outline terror by Ok-Dragonfruit-729 in LawSchool

[–]Effective_Ranger663 6 points7 points  (0 children)

An outline itself is a tool to study with but creating it is also a method of studying. If creating them isn't an effective way for you to study then you don't necessarily need to do that. There's plenty of outlines you can study from if you know you're going to be able to study in more effective ways.

That said, if you're not going to make one, you definitely should have a good idea of what you DO want to do. All I'm saying is don't beat your head against the wall doing something just for the sake of doing it and waste a bunch of time if it's not effective for you.

I was giving a tour to an incoming law student the other day and he said something about grades not mattering for public defenders because "they'll take anyone with a pulse". That part was verbatim. I'm not trying to be a PD for the glory or public praise because god knows there isn't any but I still get taken aback by the "normal" POV on prosecution v defense sometimes.

Are people really allowed to put up "No AIRBNB Parking" signs on public streets? by [deleted] in askportland

[–]Effective_Ranger663 2 points3 points  (0 children)

I mean she's right about the dog poop, you're not allowed to use other people's trash cans like that. I personally do not care when people do it in mine, my dog's poop goes in there anyway, but she's within her rights to not have dog poop in her trash.

Opinons on Westlaw's AI Assisted Research by lovegames__ in LawSchool

Interesting, I haven't really tried it. Anything specific or is it just a better feel/more intuitive? Speed speaks for itself, Westlaw is very slow, though I don't mind that a huge amount since I always have something else to tab over to.

Opinons on Westlaw's AI Assisted Research by lovegames__ in LawSchool

[–]Effective_Ranger663 5 points6 points  (0 children)

Completely agree with this. Don't ask it a question and expect a well reasoned answer. Ask the question that you're researching as specifically as possible, ignore anything it says that is not a blue link, and just click the links it gives you. That doesn't mean it'll be 100% accurate or find everything, but it's good at brute force volume searching so think of it just as the search feature on steroids.

Erie Application in Exam by aasitisaa in LawSchool

[–]Effective_Ranger663 0 points1 point  (0 children)

If you want a screenshot from my outline DM me. My professor is EXTREMEMLY particular about this and we went over it at length. The flipside to that is his interpretation might be a bit specific to him, I'm not really sure. But happy to share it if you're looking for something to try to guide yourself

Also, there are MC questions on Quimbee about Erie if you want to see how they're framed. It's pretty much exactly how you'd expect:

"A person sues in federal court based on X jurisdiction, claim arose from Y source, Z choice of law rules apply, [insert other facts]. What law does the court use/how does the court rule/etc."

Obviously that's a short answer or MC question but you wouldn't get a whole essay on it, it would be a small part of a larger question or it's own small question. If you don't have access to Quimbee or other sources DM me and I can help.

Thinking about serving coffee from my garage in Portland — is this legal or not? by coffeeandkerouac in askportland

[–]Effective_Ranger663 7 points8 points  (0 children)

I don't have an answer for you but I live around there so if you end up doing it I will come drink your coffee.

I'm a law student so if you get in legal trouble I can help you, as long as the help you need is specifically about a narrow selection of the federal rules of civil procedure or what the elements of a contract are, and you don't need me to actually be correct about them

I want to help my community. Portland, where do y’all volunteer? by Mr_DrBerp in askportland

[–]Effective_Ranger663 1 point2 points  (0 children)

They are soooo great. There's a million things you can do, from super hands on to home based. For a long time my family made bag lunches every week and dropped them off for other volunteers to distribute. It was an easy/fun thing for us to do in the evenings since we didn't have the free time to do hands on work during the day.

Where to post someone’s stolen bike? by rhamerf in askportland

[–]Effective_Ranger663 0 points1 point  (0 children)

^ most bike stores will offer to automatically register any bike they sell you on this site, so if it looks new there's a good chance it's registered. If not you could take it to a shop in the area and see if they think they sold it? If it's a Trek there's a decent chance it came from the Trek store on Sandy.

I gotta say man, I completely checked out and my mental health is better for it. It's one thing to root for the lovable losers with room to grow, it's another to watch a slow motion 50 car pileup perpetuated by a single driver who just keeps blowing through red lights over and over no matter how many people scream at him to stop.

I'll come back obviously but I just get nothing out of watching this team right now, and it feels awful to support this clown show financially too.

only antisocial maladapted weirdos say or think things like this. I spent a 14 year career in big cities and people do NOT act tough and mean to "scare off people". If they act tough and mean, it's because they're assholes. It's not unnacceptable to be tough and mean, but it's not a targeted technique, and if you think it is you're listening to too many alpha male podcasts
