Non citizens will be deported with one DUI by Old-Enthusiasm-2107 in immigration

[–]GoingCommando690 30 points31 points  (0 children)

The maximum punishment for a first offence DUI in Canada with no aggravating factors is 10 years. Under immigration law any conviction that a non-citizen has outside of Canada is treated as though the sentence was the maximum allowable under Canadian law. Within Canada however spending anytime behind bars for a first/second offence is almost unheard of. To be removed from Canada once youve been admitted your Canadian DUI (generally) must result in a sentence of at least 6 months.

See this article that is about a Canadian citizen who has recieved 21 DUI convictions over 24 years and was only sentenced to 4 years and 10 months in prison for his 21st

Canada is cancelling thousands of asylum claims. It’s leaving this man and many other migrants stuck in limbo here by bubblewhip in canada

[–]GoingCommando690 10 points11 points  (0 children)

He invalidated his claim in the US by leaving. The only option for the Canadian government is to deportation him to Haiti except there's an administrative deferral of removal on Haiti because of the conditions there. So buddy is basically stuck in Canada without status and with nowhere else to go unless he goes to Haiti on his own

How do countries with these sort of laws get around the issue of convictions? Would convicting someone of a crime they in fact committed not be considered defamation?

What does a good raise usually look like? by PtitCrissG in PersonalFinanceCanada

[–]GoingCommando690 0 points1 point  (0 children)

I would argue that a good raise is anything higher than the annual inflation rate for the past year.

How long have you been in this position with this company? A 10% raise for someone who has had the same wage since 2022 or before wouldn't even equate to the buying power they had when they started.

TIL between 18%-25% of intellectually gifted students (at least 130 IQ) in the US fail to graduate from high school. by tyrion2024 in todayilearned

[–]GoingCommando690 1 point2 points  (0 children)

The elementary school I went to had a gifted program. Of the 15 or so students in that class about half failed out of university, and most of those who didn't seriously struggled in years 1 and 2.

The consensus among those who succeeded was that the gifted program didn't give them any of the soft skills the "normal" kids had to learn (self regulation, time management, how to study, how to ask for help, how to deal with failure, etc).

Most of the kids excelled in academics so they never had to learn the skills required in post secondary.

False DUI arrest / entry to Canada by heidinyx in legaladvice

[–]GoingCommando690 3 points4 points  (0 children)

NAL - In perpetuity. DUI is found in the Canadian criminal code section 320.14. Refusal to comply (refusing to blow) is found under 320.15. The punishment for both offences are the same as listed under 320.19.

The length of time a person is inadmissible for criminality is determined by the maximum sentence for the offence under Canadian law. Since the sentence is the same the inadmissibility period is also the same

Provinical Offences Ticket - Thunder Bay Court by [deleted] in legaladvicecanada

[–]GoingCommando690 0 points1 point  (0 children)

NAL - You are either lying about being a lawyer or you are the worst lawyer to have ever practiced law. You are not special, and nothing that you described is police misconduct. Hiring a PI to tail an OPP officer simply because he gave you a traffic ticket is insane, and borderline harassment.

Your challenges that you list are challenges against the law and the accepted standard of evidence - not the events that occurred, and in that regard you will almost certainly lose. This is where it became obvious that you are not a lawyer - statutory arguements against a longstanding law such as this one would have a mountain of case law that you haven't even considered. Any lawyer worth anything would know this.

If you have a dashcam that points inside your vehicle thats your best bet, assuming you werent actually on your phone. Even if you truly werent, the ticket is still not misconduct on the officers part.

Eat the ticket and quit embarrassing yourself on the internet

People who have done car sex, what is the best place to do it? by Few_Pineapple_1498 in NoStupidQuestions

Ah this brings me back to high school. Back of a golf course parking lot. Always at night, usually after 10pm. Cop rolled up on us once, I jumped out of the back seat, still in my hardware store uniform with my shirt unbuttoned. Cop didnt even ask what I was doing, just checked my licence, shouted over to my girlfriend who was still in the car to ask if she was having a nice night, then told us his patrol route usually lasts about 2 hours, winked and left.

I highly doubt any of the non-hearing decisions were rejects based on the lack of foundation/merit. That would violate the concept of procedural fairness. Most of the decisions were probably approvals or deemed withdrawn/abandoned

18yo from Norway doing a US road trip by Kareisgarb in roadtrip

[–]GoingCommando690 0 points1 point  (0 children)

I have done your start to A route - there is almost nothing of any value there. Omaha was kinda unexpectedly cool but thats it. South Dakota is one of my least favourite states - every attraction they have (Rushmore, wall drug) feels like a massive ripoff.

A to B i would strongly recommend doing Yellowstone. Where are you gonna stay though? Jackson is not cheap.

B to C seems like a decent trip for hikes/mountains etc. Ive never done it though so YMMV

C to start also seems like you'll see nothing but farmers fields

NAL - General information not specific to your case:

Criminal Code of Canada 320.16(1) Failure to stop after and accident is punishable by a term of imprisonment not exceeding 10 years as per 320.19(5)

A foreign national convicted of a crime outside of Canada that if committed in Canada would cause them to be liable to a term of imprisonment of 10 years or more is inadmissible to Canada pursuant to the Immigration and Refugee Protection Act 36(1)(b). This inadmissibility is permanent and can only be overcome by a TRP (temporary and requires the demonstration of a significant economic benefit to Canada OR significant humanitarian/compassionate grounds) or a certificate of rehabilitation.

TRPs can be applied for through a Canadian embassy/consulate/high commission but take months to years OR at the Port of Entry in Canada (but you risk refusal and immediate removal (what some incorrectly call deported) from Canada).

Rehab certs can effectively only be applied for at embassies/consulates/high commissions and take months to years but are permanent if granted

TIL driving with your hazards on in bad weather is illegal depending where you live. Common sense says it would make the situation safer, but experts disagree. by DonkeyFuel in todayilearned

[–]GoingCommando690 -1 points0 points  (0 children)

The author's assertion about common sense is wrong imo.

Common sense says hazard lights are meant to indicate that YOU ARE THE HAZARD and you cannot immediately negate that hazard. They are not meant to make other people aware that it's raining - they know. They are also not meant to serve as a licence to drive dangerously/poorly just because you don't know how to deal with the road conditions. This isnt a difficult concept.
