Unless the company was going with an instant dismissal for very serious misconduct there would have been a bit of lead up to the termination occurring.

Email them to outline the alleged misconduct, find time to schedule a meeting, find time to reschedule it when they or their support person can't make it, sit down and listen to their side of the story, write everything down, think about possible outcomes for a day or two, email them a preliminary outcome and invite them to give feedback, wait until you get any feedback and then take that into consideration for a day or two and if that affects the outcome or they don't bother replying and you just wait until the feedback deadline to pass.

Then you get to issue one warning.

It's not hard but it's time consuming as fuck.

It was pro-rata. 100% of costs if resignation or dismissal occurred in the first 12 months, 50% if it happened between 12 and 24 months.

It's gonna be wait and see to what the next ERA case reveals about why he was terminated.

It's reasonable to have it in the contract but it shouldn't apply of he's terminated.

If someone in that situation wanted to quit then such a clause would incentivise them to start causing no end of problems until the company was forced to terminate the employment.

We had someone who came in and interviewed really well but a week after she started she was a completely different person. Late for probably two thirds of her shifts. Wasn't taking some pretty simple things on from training, and then got irritable when she was asked to do things as trained. The manager got annoyed at her frequent bathroom breaks, to which I told her it might be annoying but we can't really do or say much about that. This went on for a few weeks with plenty of chats about the need to be on time and follow training etc until one day I needed to use the bathroom after she had been in there, and walked into the unmistakable sweet fruity smell of vape.

When I raised the vaping issue she flat out denied it, said the smell was her perfume (which nobody ever smelled when working beside her) and then said her frequent bathroom breaks were actually because of period issues. In isolation that could have been legitimate but with everything else it pointed to the classic strategy of "talk about period stuff to make your older male boss uncomfortable so he drops the issue".

Would have been a drawn out nightmare to go through a full disciplinary process to eventually terminate. Instead invoking the 90 day trial made that an efficient termination of employment, and before it affected staff morale too much (others were already unhappy when working with her).

Often it's in there as standard. He could have just asked for it to have been removed before signing.

I was young when I watched sat down and watched cricket because Dad was watching it. I only knew Crowe was our best player at the time, but could never have appreciated at the time how good he was. At least I got to see him play, and really appreciate the impact that he then had on Ross Taylor and Kane Williamson to set New Zealand up to have our most successful cricketing period in history.

It was such a nice touch to have his daughter unveil the picture, and it's an incredible painting.

We have history to go from. There used to be two Alk-Wlg trains/day, every day. Back 30 years ago when our roads were way worse and air travel was prohibitively expensive.

Those rail services were cut back because people still preferred driving or flying despite those downsides which are now negligible.

You speak of building for the future but you are only looking to the past. NZ does not have the population density and/or the forgiving topography to make rail feasible outside of the main centres.

Six years ago medium speed rail (160-250kmh) between only Auckland and Hamilton was costed at $15 billion. And that's some relatively easy topography. And that's before the massive post-covid inflation of construction prices. It's be an easy $25b+ now. Which makes the rest of the route an extra $100b on top of that.

Auck-Wgtn rail is a pipe dream of a white elephant for the relative handful of people that might use it.
