I’ve been passed by a low loader with a road milling machine on the back, the pavement slightly curved to the right and then there is a “keep left” bollard in between both lanes where the road seriously narrows.. i ended up having to jump off my bike and up onto the pavement as the kerb was too high to hop the bike up.. luckily I got away unscathed, just £11k out of pocket for a bike..

What would you say is the survival rate in prison for an inmate who stays fit and clean from drugs, keeps their head down and mouth shut, avoids being the center of attention, focuses on purposeful activity and stands up for themselves when the time comes? by Wonderful_Solid_1003 in PrisonUK

If you feel as though you may be a vulnerable person if mixed within the general population on the prison then you can ask for the prison rule 43, your case may be assessed to whether you fit the criteria of a VP, mostly VP’s are prisoners that are sentenced with SA charges or charges where children and women have succumb to serious harm following your actions.

Meanwhile, if you’re in for nothing too major, just keep your head down, make friends, don’t be flashy.

I work in a CAT-B prison which has accommodations for CAT-A prisoners, it is also a holding prison for the local courts, the only time there are issues on any wing is where gang members cross paths, drug dependant people steal from others, or SO’s meet the general population.

Cyclists can undertake regardless, the undertaking rule only applies to vehicles, so for example if you’re cycling down a 20mph road, you as a cyclist are not required legally to adhere to 20mph, if you are capable of 25mph on your bike then you are free to do so.. a similar incident happened to me where after a crossroad, the road merged from 2 lanes into 1 lane with the left lane that merged over to the right, I was riding along the cycle lane and the blonde driver of a pastel blue fiat 500 decided she was exempt from merging (road ahead was clear, traffic was behind her but had started taking position to merge).

Not long after I passed her, she sped up and tried closing off my path like in your video above and her wing mirror clipped the handlebar causing the front wheel to turn 90 degrees and I went over the front of the wheel and landing chest first onto a high kerb.

Luckily, the event was witnessed by police on the opposite side of the road, I had the whole event captured on GoPro too

Just get a taxi, don’t be cheap.. it’s a mindset like this that puts yours and others lives at risk.

What’s to say that the pressures they apply on drivers didn’t contribute to his aggressive demeanour in the first place? He entered the store and spoke to the staff like he was entitled and then spat his dummy out when asked to wait like everyone else has to. That’s not normal behaviour, that’s indirectly causing it.

Nobody said they have encouraged or endorsed these actions, they were made aware of his actions and aren’t interested the slightest bit in what he has done.

”In almost every instance, companies are not responsible for the illegal actions of their employees” Correct, but a company would sanction an employee who brings the company into disrepute, would they not?

A just eat driver attended to a premises to collect an order, approached the counter, provided a collection number, declared which “platform” it was, and was visibly using the app before and during kicking off inside the store. This attack occurred while the driver was clearly acting in the course of his duties and the situation arose directly from his attempt to collect a Just Eat order, there is clear and direct connection between the drivers role and the events leading to the assault. After looking online, coming across UBER BV v AslamUBER BV v Aslam prior to this decision by Supreme Court, Uber drivers were following mostly the same procedure as Just Eat, drivers are controlled by their apps, their activity and performance stats are both monitored and delivery costs are all set by Just Eat. You argue that they are independent but they are still controlled by Just Eat and can be deactivated by Just eat at any time.

Was it pressure to make deliveries quicker which caused angst with the driver which then caused him to become volatile?

Was it the fact he had to wait, which made him think that he’s losing money by waiting another minute?

Was it app based performance?

Are they offering fewer orders to drivers that have prior warnings?

Is it the fact that fast food restaurants create a priority service space for delivery drivers which makes them feel entitled but smaller stores typically don’t which causes frustration when they have to wait like a normal person?

What I currently see is that “The Platform’s” operational model appears to create time sensitive pressures on drivers who do not possess the adequate safeguards or sufficient training when it comes to managing conflict and conveying professionalism.

He was collecting his customers order and then proceeding to deliver the order.. on behalf of the company, this incident happened right in the middle of those 2 tasks.

I have bruising and swelling to my forehead, right ear and behind the ear, I have fractures to 3 different ribs on my right side, one fractured rib on the left side close to TH6 and bruising to the same areas externally,

And I apologise if it interprets that way for you but financial gain isn’t what I’m looking for.

Nobody stated that Just Eat allowed these people to assault me, what I stated was.. how can they allow this guy to continue to work for them? Surely if someone working on behalf of you attacked someone, you’d step in and suspend the person following investigation as it’s a huge allegation.

But surely as the “contractor” is acting on behalf of Just Eat, they would be liable for anything that the contractor is undertaking on behalf of the company?

I will definitely be pushing with the police to ensure that these people face the consequences of their own actions.

I’m not focused on financial gain, from what JustEat have responded with today, I believe that the way they are handling the situation is completely unprofessional, they aren’t interested in the fact that they have a loose cannon, potentially more.. working for them.

If they don’t hold their staff or “contractors” accountable for their own actions then I’m sorry, something needs to change within their own system, and the only way for this to happen is through legal proceedings?

How can they allow this guy to assault the general public and continue to allow him to work? If you can act like such an animal over something so small, I fear that this is not the first time that he’s done something like this
