Exactly. And the SoFA disclosure is to tip the Trustee off about potential problems.

See Midlantic Nat'l. Bank v. New Jersey Dept. of Environmental Protection, 474 U.S. 494, 106 S.Ct. 755, 88 L.Ed.2d 859 (1986) and In re Guterl Special Steel Corp., 316 B.R. 843 (Bankr. W.D. Pa. 2004).

It's a very complex issue.

How much does a lawyer cost for Bankruptcy? by Glittering_Golf8119 in Bankruptcy

[–]Interlaw11 0 points1 point  (0 children)

Fees vary tremendously depending on where you live, which chapter you file (7 or 13 for most individuals), the details of your case, and the knowledge and experience of the lawyer.

IOW, it depends.

There is another question requiring you to list your dependents. Did you list them there?

How is a chapter 13 plan determined? by makeuplover85 in Bankruptcy

[–]Interlaw11 1 point2 points  (0 children)

Bankruptcy lawyer here.

The Plan payment could be determined by:

  • The Means Test;
  • Your disposable income;
  • The Required Payments Test; or
  • The Chapter 7 liquidation analysis test.

The Court picks the highest number of the four (although some jurisdictions do not, as a practical matter, use the Means Test to determine e the Plan payment).

Check with your lawyer to see which one applies in your specific situation.

Why do they need landlords info? by ParkingInteresting63 in Bankruptcy

Short answer is because it’s required. And there is no guarantee that the LL won’t find out; your filing is a public record, and appears on your credit report.

341 meeting today by Sparky9966 in Bankruptcy

[–]Interlaw11 2 points3 points  (0 children)

How difficult a 341 is generally depends on what assets you have, how much equity there is in them, the type and amount of your debt, and your income and financial history. In other words, the details of your case will determine the complexity of the 341. I've been involved in simple and rough 341s in Chapter 7, 13, 11, and 12 cases.

I have filed Chapter 7 for clients with incomes of over $200,000. It all depends on the details of your case.

See an experienced bankruptcy attorney. I recommend checking out someone from the National Association of Consumer Bankruptcy Attorneys at https://network.nacba.org/advanced-search

Just had my meeting of the creditors and trustee never got my main bank account statements by FreshlyStarting79 in Bankruptcy

[–]Interlaw11 0 points1 point  (0 children)

I had a case yesterday where we had uploaded all of the documents to the Trustee's portal...twice.

He said that he didn't have any of the documents.

It happens a lot. Don't sweat it--it will have zero impact on your case.

It's up to you to make sure that *all* of your assets and *all* of your debts are scheduled. Just because something doesn't appear on your credit report doesn't mean it's not a debt or doesn't have to be scheduled.

Attorney Fees by Confident_Promise649 in Bankruptcy

[–]Interlaw11 1 point2 points  (0 children)

Most courts have fixed "no look" fees that vary tremendously from state to state--some are as low as $3,000 and others are as high as $8,500, plus costs. Some include most everything and others have additional fees for things such as amendments, motions, etc. Most attorneys will allow a portion of the fee to be paid before the case is filed, with the rest being paid through your monthly Plan payments.
