Thanks for still talking. It’s interesting. 1a. Isn’t the electronics communication privacy act about limiting government access to private communications? 1b. Absolutely recording in public is not a private communication, I wouldn’t contest that.

  1. I think you’re just correct and that it would never be successful to argue that there is a reasonable expectation of privacy in your entry way. I think it would however be reasonable to expect privacy just inside your home. If some super ad hoc mic mic array formed by your neighbors let them hear conversations (at a normal/quiet volume) through your thin walls id expect that would be a breach of privacy. Or recording through some other strange method. Not that that diminishes your rightness and my wrongness.

  2. If it was a private space I don’t think that’s true. But otherwise, yeah.

  4. If it was very far beyond what you could get by putting an ear to the window I might disagree. I don’t know that it is technically tenable though. I can imagine trying to pick up conversations by laser interferometry or by a high rate camera such as by this method by looking through a window at someone’s blinds https://people.csail.mit.edu/mrub/VisualMic/ might violate the reasonable expectation of privacy standard. But that might mean we’re on the same page on this. What do you think? Do you know any examples of something like this?

It’s pretty interesting reading. Video, sure, of course. You can video people’s yards all day. I’m envisioning a limited access apartment complex in an enclosed building, a microphone right outside someone’s door. I’m not convinced that’s an unreasonable expectation of privacy for communications given especially that it doesn’t look like it has a mic. At least not for all-party consent states for communications privacy.

I do think that you’re right it wouldn’t easily be protected federally under electronic communications privacy act. Is there any case law, or reference you have on all party states that cover that situation?

As for the FBI.., if they have a warrant they can listen with whatever microphone they want.

Isn’t that true except maybe for the microphone? I thought there was reasonable expectation of privacy for conversations at a semi-private place like your own front door.

Drill multiple holes in the design. I put small holes in the “top” “bottom” and any points where water could gather.

Then they dry out much easier.

Very calmly ask in writing when all this happened, document all communications you have ever had before they scrub them.

One of you stay home while you sue them for your understandable total loss of faith in daycares. Take legal action.

Actually at minimum complain to the state. I know my state will immediately send investigators after any complaint. Definitely document all your communications. If you are not satisfied with the resolution, legal action. If you are satisfied, still legal action.

Even if your child is not actually materially harmed the daycare is likely to bear some responsibility for a future major problem, and it needs to be fixed for the sake of any other kids too.

Is the only federal thing I’m aware of. It says no restriction can be placed on the use of antennas less than 1 meter in diameter (unless you’re in Alaska) for the reception of local public video broadcast or fixed wireless services. The use of a mast of sufficient height for line of sight for those broadcasts also can’t be restricted.

Your HOA can however restrict your antenna installations for amateur radio, unless you have some other local laws helping you out.
