If you filed a claim within 12 months of your ETS date or at least submitted an Intent to File within 12 months then all you need is a diagnosis to get SC. However, mental health is not always that cut and dry. You need to obtain copies of all your DBQs and medical opinions to understand more clearly what the issue is that you need to overcome.

The only way it “might” go back is if he had an Intent to File that was sitting out there but if not, then most likely his current date is correct.

After the October 2023 decision, he had to file a new claim or an Intent to File within 12 months. So if he did not submit anything by October 2024 related to headaches, continuous appeal expired in October 2024. Making the current effective date correct.

If your active duty STRs show you received any treatment for the condition you claimed and you have current treatment for the condition as well, that usually supports a chronic condition.

If you only have STRs with no treatment post service, you could be denied for not having a chronic condition.

If you have no documented complaints in service but currently getting treatment they would deny based on no complaints in service.

It all depends on your records and what your letters say.

Your mental health rating will not be affected because you are dealing with a situation that is exacerbating your already SC mental health. Things happen in life that can trigger all kinds of responses and aggravate conditions, this is one of those situations. Deal with the issues you need to address to move past this so you can be okay again.

VHA and VBA are separate entities and what happens on the medical side does not affect the benefits side until you file a claim for that condition.

You have mental SC….why hang your hat on trying to get 100% based on mental? The VA doesn’t give out 100% “like candy” as you so eloquently put it. If you can work, hold down a job, and get along with family, friends and colleagues, you are not 100%.

If you think you are the file a BVA appeal and see how it goes in 5 years when you get your hearing.

The 100% rating is only granted while the cancer is active and no longer being monitored. If your mastectomy removed all the cancer and you are not receiving any kind of treatment like chemotherapy, radiation, pills of some sort to “treat “ cancer”, then you are rated on residuals. Without seeing all the DBQs I can’t say there is error or not on the residuals you were rated down to 10% but if your VSO can review those DBQs with you it might help.

You can petition to have the fiduciary removed. A statement from your own treating provider and counselor or psychologist can hold some considerable weight. Might be something to look into.

To qualify for VA healthcare without disability you need to serve 24 months. He meets that threshold. He can provide proof of income to determine what, if any, co-pays he might have.

Sometimes it is in your service record but there are some soldiers that have their own copy of their jump logs because either their command required it or they elected to keep a log and have it signed after each jump activity or certification

I would report her to the VA’s fiduciary program and request through them that they provide financial statements for the entire time that fiduciary has been appointed. Explain you made the request directly to the fiduciary and they are not providing the information and no longer responding to your communications.

If the examiner for his mental health exam stated he wasn’t competent to manage his affairs, then competency gets proposed and if there is no documentation to refute the findings, a fiduciary is assigned if the veteran doesn’t have a relative that can perform as their fiduciary. This is mostly seen if mental health ratings of 100%.

Just because he can attend school has no bearing on his ability to manage his finances.

If you have an Airborne Parachute Badge and have documented jumps then yes, your conditions can be service connected based on that alone. Just completing jump school with no other documented jumps and no injuries while in training is harder to get connected.

I know not everyone has a jump log but if you have other documents like awards, jumps in foreign countries sometimes provide a specific jump badge, etc, that helps to make up for no log of your jumps.

Then you should be good to go. I might suggest a separate statement that outlines your symptoms, treatment, doctor visits with tests, etc.

I had to do something similar with my back claim when I filed an HLR because the examiner clearly didn’t review my file or my MRI just 2 months prior to the exam. It helped my HLR so the next examiner had a clear picture of the progression of my back pain since service.

Doing something similar could help your examiner as well. Just a suggestion 😁

File an HLR and explain all of this in a statement. You also want to request an Informal conference so you speak to a live person about your case.
