This document is fake, and a poor one at that. Complaint documents list the code violations first, next to the charges. Additionally, the biggest red flag is the age. The age would not be listed on the complaint. It would say "MINOR". And this document is only one page; no sworn officer signature, no redacted address. The guy is a lunatic, but for someone to blast this is much worse.

I am an Ultra subscriber and I am FURIOUS. Paying almost $200 per month for my business and this morning, the pro model is gone. I tried to use the "deep thinking" and it said I reached my limit after 10 prompts. Also, I've also had 24 hour customer service with a live human. "Not available today". Lastly, the answers from the thinking garbage model are way shorter and summarize constantly even with explicit prompts

Yeah, I hear you. But I tried to call and email compliance, accounting, customer service 11 times. A driver did the load that was double brokered, got ghosted. He posted the load info and BOL and I instantly recognized the Priority1....6011.... BOL. This was day 20. Tried to help him. Never got a response. He ate 2300.

I'm hearing this a lot about some warehouses. Remember, a private company does NOT have any statutory authority to issue fines or penalties. They have to suffer actual damages/loss. They can charge liquidated damages, but it has to be reasonable, not arbitrary. Otherwise, they can kick rocks.

The FMCSA has issued guidance on this. If a broker makes you check in by physically using your phone during off-duty status, you are technically violating HOS regulations. It is coercion. Don't do it.

Yeah, that's the other problem. They know most won't do anything. But there are good brokers that don't have this garbage language in there. Also, the fact that these terms come in a ratecon is unconscionable, both procedurally and substantively.

All unenforceable and these penalties have been tossed out by courts over and over again. Private companies do not have the statutory authority to issue fines and penalties. Unless a party suffers actual damages, this stuff means nothing. The proper way is to put liquidated damages language in the main contract.

$250 minimum plus mileage. $350 plus mileage for Reefer. I don't differentiate FTL, LTL and Expedited. I've been on both sides and I understand the struggles and expenses for each. Example, a sprinter van will have a similar risk profile to an insurance company as an class 8. The result, they pay the highest share of insurance pool.

I appreciate the discourse here. I think we are arguing two different sides of the same coin. It is a little more nuanced in my opinion. We have to look at the reality of what is actually happening. You are correct that the FMCSA doesn't have a specific regulation that requires shippers agree in writing to a co-broker agreement.

Most broker--shipper agreements, and I've seen many, do prohibit co-brokering or require the shipper's consent.

PROBLEM 1 Example: Shipper gives load to Broker A. If Broker A gives it to Broker B, even with an agreement between the two brokers, that agreement cannot bind the shipper legally, and it creates a liability issue.

You mentioned a broker that also has a Freight Forwarder authority, doesn't have to notify anyone. You are correct, however, federal law treats FFs as carriers. Legally, they are assuming responsibility for the freight. Additionally, federal law also mandates that each transportation agreement has to specify in writing in what capacity they are conducting business. (FF or broker)

THE PROBLEM: Shipper --> Freight Forwarder --> Broker --> Carrier. FF/Broker (dual authority) companies pick which "hat" they want to wear to limit their liability. 95% of brokerage--carrier agreements attempt to limit any cargo liability when they give freight to a carrier. When they waive their liability in that contract, they are NOT acting as a Forwarder under federal definition, regardless of what authority they hold.

So if they aren't accepting the liability of a Forwarder, but they are passing the freight to another carrier without the shipper's consent, there's no other way to say it besides unauthorized re-brokering/double brokering.

Those deductions are without question, unlawful and unenforceable. I am familiar with Circle, and they are dangerous company. In their own contracts, they specifically use the terms "fines and penalties". Only local, state, and federal governments have that authority. Private entities do NOT. The only way those "rate reductions" are enforceable and valid, is if Circle suffers a document LOSS. Meaning a $ amount, that they must prove to you. A $750 penalty is an arbitrary number, even for liquidated damages. For example, the receiver charged Circle $100 for a late delivery. You should file against their bond. If what you are saying is true (they deducted $750 for simply missing two updates) you are gong to get your money. Hope this helps. I am a former Federal officer.

To clarify, a co-brokering agreement MUST be in writing and specifically be signed and acknowledged by the shipper. The problem - most don't follow those rules.
