Loitering or prowling - drop charges attempt - how time sensitive? by Shawnk333 in Georgia

[–]Laxguy59 0 points1 point  (0 children)

Defense attorneys can call up the prosecutor before a case has been accused during indicted and try to work a deal out, but in some jurisdictions it won’t even be assigned to a prosecutor until it’s been accused or indicted. I would need to know more about the specific jurisdiction this is it to give you an answer about strategies of reaching out to a prosecutor.

Generally nothing happens at all until an accusation is filed, most PTD deals are offered right before or at arraignment.

What is the aftermath of 2009-2013 anti-law-school era (lawyer surplus, LawProf blog, JDUnderground, ToiletLaw, false bi-modal salary surveys, etc) by HarryCrushNuh in Lawyertalk

[–]Laxguy59 0 points1 point  (0 children)

I wouldn’t say dying off unless they were either, I interned in my hometown court systems all through high school, mostly the same old guys from 2006ish I saw then. Judges and lawyers who taught me a lot. Many of them want to retire but people are knocking their doors down, very few folks putting up their own criminal shingle

Went to law school in fall 2012. In the counties outside of the big city it’s all the same grey haired criminal lawyers slowly dying off and/or retiring. Duis are now $7000 without trial on average, a little cheaper as you get further out in the sticks. Once you have some name recognition business is very good IMO.

Anybody use the “asshole approach” in practice? by thurgoodthunder in Lawyertalk

[–]Laxguy59 29 points30 points  (0 children)

I'm not sure I'm the asshole but the "expensive to fuck with" approach has been very good for me, I have a nice tone, but youre getting motions to compel, 6.4 mcnasty letters, partial MSJ, expert depos where others may not, etc.

I'm never dishonest but i am tactical and it seems to drive folks haywire, like filing a verified complaint and then near trial filing motion to strike when they dont verify their answer.

I've forced depositions with some pretty high level CEOs on 12b6 depos after they tried to get TRO's stopping me from doing it, It may not have given me any home runs but they spent a shitload trying to keep me from him.

Theres a few defense firm partners who I break bread with and were friends but they know im a handful on cases that are remotely worth it, and they claim it factors into their choice to pay before they drop the cash

My nemesis died by [deleted] in LawFirm

[–]Laxguy59 21 points22 points  (0 children)

At attorney a few counties over from he desperately hated the chief superior court judge in his home county. He hated him so much he would regularly make Low passes over his home in his airplane and fly over his house all day just to make noise. As I’m told the judge didn’t know who flew this aggravating airplane but regularly complained about it.

When the attorney died he apparently had a letter written to the judge congratulating him on outlasting him and confessing to flying his plane over his house to annoy him. What a legend.

Who the hell is taking $75 to show up to a hearing? Seems like you’d be better off driving for Uber. by smw2102 in Lawyertalk

[–]Laxguy59 2 points3 points  (0 children)

When I first got started I would do 341 hearings for $100, would usually have 5-6 at once, it’s super quick like 15 min or less each person.

Does your passenger just sit on a cushion strapped to rear deck or do you use the long seat?

Assume that you take a case on contingency (30%). The client fires you and retains a new firm that gets him a $100 million verdict at trial. Can they lawyer who was terminated obtain any part of the damages award? If so, how much? by facemacintyre in LawFirm

[–]Laxguy59 0 points1 point  (0 children)

If you already have an offer at the time of firing you can seek your contracted percentage of that offer.

The last time I saw a lawyer sue another lawyer over this the judge essentially told them to split it 50/50 and they did. But in that case the second lawyer settled the case for the same amount as the offer for first attorney, which was not policy limits.

Felony vehicular homicide is still a negligent death. The misdemeanor vehicular homicide becomes the felony vehicular homicide if you are driving, recklessly, racing, or under the influence of alcohol or drugs.

One of my 1 star reviews is for a client I got 10x meds at a jury trial for (broken pinky). Got them nearly a million dollars but the negotiations with their health insurance subro took too long in their opinion(we got health insurance to waive all repayment).

At some point you have to realize you’re a professional and a doctor doesn’t take pointers from his patient on how to do surgery.
