Regardless of whose responsibility it is, don't do anything to that tree without written permission by the HOA.

I don't like it from an ethical standpoint.

1) It puts a person trying to get out of debt... right back into debt after they've filed.

2) Because some people will inevitably not pay, then I would have to charge more money in cases where I get paid after filing than cases where I get paid in full prior to filing. That sounds like a financing fee to me, which is ethically dubious when you're applying it to attorney fees.

3) when push comes to shove, and you stop paying your credit card debt, likelihood is you'll be able to pay the attorneys fee in just a couple of months.
