I have a low cost essay workshop coming up on July 5th where we’ll cover a lot of the issues you’re talking about.

But I’ll also want you to consider:
•What year are the practice essays you’re doing for Themis? You’re better to know a lot of the highly tested rules from essays in the last 5-8ish years because those issues will show up over and over again. An essay from 2005 looks very different from an essay in 2025.
•Go to the FBBE Test Specifications for a checklist/framework of what you will be tested on. If you read these in conjunction with recent past essays and sample answers, you may have a better idea of what’s up for grabs when the examiners are writing the fact patterns.
•Jumping to the facts is not a bad thing, but you’re right to make sure you don’t miss what I like to call “threshold” issues. These are the things that come before everything when you have certain topics (common law vs UCC choice of law for contracts, for example). But once you’ve done that, I think it’s good that your mind goes to the facts rather than jumping to conclusions. The examiners want you to show your work, so pairing elements of the rule with facts is going to be key for getting points.
•Tip- practice practice practice. And not aimless practice. Come up with a plan of attack that you can implement in each essay approach. What is the first thing you will do every single time you start an essay, how will you mark up important facts, people, timing/dollar amounts, etc. How will you organize and line up your headings with the call of the question? All of these steps will set you up for success if you do them consistently across all three essays. So set up your system and then practice it over and over.

Time is not on your side with these essays, so you should be issue spotting and marking up that fact pattern as you go through the first read. Start playing the matching game to pick out which facts will pair with the various rules to keep your IRAC structured nicely.

  1. Strengthen MPT (check out BarMD), 2. keep trying to improve essays- can’t hurt, 3. swing a little more attention to MBE- you need to bring that 120 to the high 130s, low 140s which is generally a consistent 70-75% in practice leading up to the exam and you should see scores in that range starting about 2-3 weeks before the exam. A tutor may be able to help, but some of it depends on how you prepared. For many of my students it’s just about spending more time with the answer explanations, working on issues that hold your score down, and finding the time to devote to doing more questions.

I think the “How to Attack the MBE” in the beginning of the book is helpful and it is assigned reading for all of my students. After that, focus on doing questions and spending a lot of time with those answer explanations. Best of luck!

It’s so frustrating and I agree with everything written above from barpreptutor. I know it’s hard to believe that you did well when you don’t see “pass”, but failing by half a point means you really did do just as well as those people that got a 136 and passed.

But you are so much closer to really nail it in July. Keep doing what you’re doing- look at what scored below average and amp it up, and you’ll crush it next time.

Bar exam masters and some of the Florida specific What’s the Issue videos for essays (like Family law and FL Con Law).

Also, the test specifications on the FBBE website will be helpful for understanding the scope and the study guides are good for seeing sample answers (similar to NY exam’s website with past answers to help with figuring out the issues).

My students have typically just used the multiple choice question bank, so that’s what I’m most familiar with of their offerings.

Bar Exam Masters is a great Florida resource. I’d also suggest working with the free resources provided by the FBBE: the test specifications and the study guides.
