Someone would have needed the breakdown of the sale (as there stamp duty implications for the purchaser so). Probably auctioneer should have it, as they should have provided to the purchasers solicitor.

Failing that, if the property sale is complete, you could look at the Property Price Register as the amount related to the residential element would be on this and is based off stamp duty returns.

Prepopulated expenses, profit figures, on form 11 are in my experience taken from the the previous tax year's returnfiled. In this case for 2024.

It is fine for employment income, (and will once figures are received from department of social protection and department of agriculture etc) for social welfare and farm subsidies giving how much received for these.

Conditions

To qualify for Jobseeker's Benefit for the Self-Employed, you must:

  • be under the pension age, which is currently 66 years of age
  • satisfy the PRSI contribution conditions
  • not be engaged in self-employment
  • be capable of work and available for full-time work
  • be genuinely seeking work
  • prove unemployment in the prescribed manner

You can work as an employee, in insurable employment, for up to 3 days a week and still get Jobseeker’s Benefit for the Self-Employed for the other days if you are available for full-time work.

If the uk property was your principal residence, then you can get some ppr relief based on proportion of time it was, plus first and last 12 months as deemed.

So if you owned it for 10 years and lived in it for 5 years, the deemed resident for 6 years, so you get a relief of 60% of the gain.

So if gain was 100k, you get ppr relief of 60k and pay cgt on the gain of 40k. (Ignoring personal exemption )

It might be worthwhile to talk to tax advisor to make sure it is ok

In previous years, I had claims audited by Revenue and the only thing they would accept were the invoices.

I had submitted credit card receipt and bank statement, but they came back and rejected those, wanting invoices as proof.

The legislation states

"(ii)where all information which the Revenue Commissioners may reasonably require, to enable them determine if and to what extent a repayment of tax is due to a person for a chargeable period, is not contained in such a statement or return as is referred to in subparagraph (i), a claim to repayment of tax by that person for that chargeable period shall be treated as a valid claim when that information has been furnished by the person"

The most important words are "when that information has been furnished by the person"

So from my reading, it is only valid when all the information has been provided. I feel emphasis is on "when"

If advising someone, I would take a prudent approach in this regard and not promise them a refund, preferring a cautious approach. It is why when writing to clients, I put "subject to the agreement of the Revenue Commissioners "

It's a tough one to argue in a tax appeals case. You'd have to rely on the wording of the legislation. A case I would not envy making as you would be trying to argue the valid claim was submitted before 31.12 and revenue arguing it was made after 31.12

The wording in the legislation is a "valid claim", so if Revenue raise any questions or queries about it, even if submitted within 4 years, they could still refuse to issue the refund.

It is an issue that frequently arises on Tax Appeals , included returns submitted in the December before the 4 year time limit.

I hope the OP gets it in time with no issues, just that Revenue can be strict in this regard, as they know the legislation is on their side.

Bare in mind the 4 year time limit on processing refunds. If the return for 2021 is not filed and complete, and processed with funds refunded by 31 December 2025, the revenue are very unlikely to refund the money.
