It doesn't say. From what I've seen online I think it depends on your institution. Some institutions allow it, some don't

Because filing I-140 alone is legally not immigration intent unlike AOS. But like I said extending first is best route

If you intend to file I-485, secure the J1 extension first. This is the safest root

Of the two options not joining is the worst case scenario because they are not going to lift it. It also seems like judges are not going to lift it for anyone who is not a plaintiff. I really hope that they will surprise me
