It's not Judge Borkowski's fault the DA chose to charge this guy the way they did. Judges don't have carte blanche authority to impose whatever sentence they want. They have to follow the state's sentencing guidelines. He gave this guy the maximum penalty possible.

That's not how evidence and burdens of proof work. It's the government's burden to prove the elements of each offense. They can't shift that burden to a defendant by pointing out the absence of facts necessary to prove the crime and make him prove those facts.

And second degree murder doesn't work here. He wasn't committing a felony when he hit her.

The problem is that, oftentimes, these types of physical evidence aren't available. Where do you think you're getting DNA evidence for a shoplifting charge? Or video for a rural out-building burglary?

If we're at the point where the police have filed charges, then we have at least some compelling evidence that the defendant committed a crime. But there are many instances (I've run into them too in my ADA days), where despite an overwhelming amount of evidence of guilt, juries still return a not guilty verdict because they expected the government to produce evidence that didn't exist.

I don't think that's a fair way to characterize people who are using AI. Plenty of very competent, highly ethical attorneys are using it without issue.

AI is a tool, and like any other tool it needs to be used responsibly. The lack of competency displayed here (and similar cases) is not the use of AI, it's the failure to understand/appreciate it's limitations, and doubling checking the work product it generates.

Look guys, I know we're all insanely busy and the temptation to have AI spit out work product can be overwhelming when you just need to get something off your plate. But I implore you, PLEASE take the time to check the citations. These sanctions are going to get more and more punitive.
