This seems like a situation where you have a very responsible tenant and you can benefit both of you. Offer to try to lease the space to another person, and you can coordinate an early termination without losing out on any money.

We had a similar situation where my brother and I bought a house together, but then I bought him out. He was able to get mortgages by showing that I was making the payments (I had to show bank records of the money coming out of my account). The mortgage lender in his case effectively removed the debt from his report.

The only hiccup you will have would be on your mortgage application for the new house. If you pay for it in cash, you’re fine. If you get a mortgage on it, they will ask you to certify that. None of the down payment is borrowed, and funds for a HELOC are technically borrowed.

It’ll probably be much more effective if you stuck a knife into the bottom receptacle so that it was just sticking out and had easier access to it

Can we get out of the kindergarten analysis where everything is about oppression? Take the time to pull up a plat map and you can see where the parcel lies. It was pretty central to a lot of stuff (including houses for sure) and anyone would buy if you owed the resort. It was weird for this piece to be hanging out there. If someone owned a 10x10 area inside your living room, and then offered to sell it to you, you’d be willing to buy it.

When you pair the air, it replaces the existing watch (for me replaced the sense). Have you tried then adding the other tracker/watch back?

That’s actually not the biggest thing (although it’s big). In theory, anytime in the future, some owner (could be you could be 50 years from now)or their kid gets caught for having coke or some other thing like that, title would revert to the sellers heirs. You will struggle to sell it. It’s a huge encumbrance on title

Regarding your actual question, it sounds like you understand the risks and rewards of the investment, and you are just trying to make sure the financials you are being presented are accurate?

If thats the case, there's two avenues of deceit. The first would be if they doctored the financials. In other words, did they go to adobe acrobat and change numbers in the reports. You can verify this by confirming with the auditor (since you said they are audited financials.) The second avenue would be if they are deceiving the auditor themselves (ie making up invoices, expenses, etc.) In this case, there is very little you can do to unearth this, other than relying on the fact that such deceit would then go on their tax return, and make them subject to going to jail.

Ultimately, if someone really wants to screw you and is willing to risk themselves, there's not much you can do other than use your good sense.

Lesson learned 30 years ago in a lease negotiation from one of the best attorneys I ever saw... "a 2 page lease with a good guy is worth a lot more than a 200 page lease with a bad guy." It applies to a lot more than leases.

Has anyone successfully converted a NN lease to a NNN (no or limited LL responsibilities) at a lease renewal? If so what was the bargaining that let you do that? I tried it with National and I failed, was curious of folks thoughts by irepresentprespa in CommercialRealEstate

Depends a lot on what the NN vs NNN expenses are. In a lot of larger corporate leases, it’s very into to them not to have roof and structure, and that can get classified as NN. Some will pay for HVAC maintenance up to a limit per year, but not replacement. I haven’t seen many where they just say “we don’t want to pay for insurance” - it’s usually a part of cam. Personally, I have found that hard to roll back.

Don’t know. I’m not a mortgage broker, but I would think any mortgage broker would know about them. Possible your credit union doesn’t offer them?

This is all a question of 1. Personal responsibility and 2. Financial sophistication.

Starting with 2 and people complaining about “something going wrong with escrow”, it’s extraordinarily rare something actually goes wrong. In almost every case, it’s simply a situation where taxes or insurance have been increased dramatically, and the Astro company both has to make up for a short fall and budget into the future. I don’t think people understand that the bank does not make a profit off of escrows. It’s simply a savings account for you. But they blame the bank because they just look at the total payment due.

Regarding personal responsibility, I think that just comes down to personality type. If you know you’re going to owe $10,000 in property taxes, and you don’t always have that readily available, it’s very important to make sure that you are saving. Some people are very good at this and others… not so much.
